Dear Ms. Spiller:
You ask whether certain information is subject to required public disclosure under the
Public Information Act (the chapter 552 of the Government Code. Your request was
assigned 640608.
The Texas Commission on Jail Standards (the ??commission?) received a request for all
information related to a named individual and the work schedule for speci?ed employees
within a speci?ed period of time. Although you take no position with respect to the public
availability of the submitted information, you state release of this information may implicate
the interests of LaSalle Southwestern Corrections (?LaSalIe?). Accordingly, you inform us,
and provide documentation showing, you noti?ed LaSalIe of the request and of its right to
submit comments to this of?ce as to why the requested information should not be released
to the requester. See Gov?t Code 552.305 (permitting interested third party to submit to
attorney general reasons why requested information should not be released); Open Records
Decision No. 542 (1990) (statutory predecessor to section 552.305 permitted governmental
body to rely on interested third party to raise and explain applicability of exception to
disclosure under the certain circumstances). We have received comments from LaSalle.
Additionally, we have considered comments from Bowie County (the ?county?).
See Gov?t Code 552.3 04 (providing that interested party may submit comments stating why
information should or should not be released). We have considered the submitted arguments
and reviewed the submitted information.
LaSalle claims section 552.103 of the Government Code for the submitted information.
Section 552.103 provides in relevant part as follows:
Information is excepted from [required public disclosure] if it is
information relating to litigation of a civil or criminal nature to which the
state or a political subdivision is or may be a party or to which an of?cer or

employee of the state or a political subdivision, as a consequence of the
person?s of?ce or employment, is or may be a party.
Information relating to litigation involving a governmental body or an
of?cer or employee of a governmental body is excepted from disclosure
under Subsection only if the litigation is pending or reasonably anticipated
on the date that the requestor applies to the of?cer for public information for
access to or duplication of the information.
Id. The governmental body has the burden of providing relevant facts and
documents to show that the section 552.103(a) exception is applicable in a particular
situation. The test for meeting this burden is a showing that (1) litigation is pending or
reasonably anticipated, and (2) the information at issue is related to that litigation. Univ. of
Tex. Law Sch. v. Tex. Legal Found. 958 479, 481 (Tex. App?Austin 1997, orig.
proceeding); Heard v. Houston Post Co, 684 210, 212 (Tex. App?Houston [1 st
Dist.] 1984, wri! ref ?d n. r. e. Open Records Decision No. 551 at 4 (1 990). The governmental
body must meet both prongs of this test for information to be excepted under
section 552.103
To establish that litigation is reasonably anticipated, a governmental body must provide this
of?ce ?concrete evidence showing that the claim that litigation may ensue is more than mere
conjecture." Open Records Decision No. 452 at 4 (1986). Whether litigation is reasonably
anticipated must be determined on a case-by-case basis. Id. Concrete evidence to support
a claim that litigation is reasonably anticipated may include, for example, the governmental
body?s receipt of a letter containing a speci?c threat to sue the governmental body from an
attorney for a potential opposing party. Open Records Decision No. 555 (1990); See Open
Records Decision No. 518 at 5 (1989) (litigation must be ?realistically contemplated?). On
the other hand, this of?ce has determined that if an individual publicly threatens to bring suit
against a governmental body, but does not actually take objective steps toward ?ling suit,
litigation is not reasonably anticipated. See Open Records Decision No. 33 1 (1982). Further,
the fact that a potential opposing party has hired an attorney who makes a request for
information does not establish that litigation is reasonably anticipated. Open Records
Decision No. 361(1983).
Initially, we note section 552.103 is a discretionary exception that protects only the interests
of a governmental body, as distinguished from exceptions that are intended to protect the
interests of third parties. See Open Records Decision Nos. 542 (statutory predecessor to
section 552.103 does not implicate the rights of a third party), 522 (1989) (discretionary
exceptions in general). Thus, we do not address LaSalle?s argument under section 552.103
of the Government Code.
Additionally, we understand the county to argue that it reasonably anticipated litigation when
the commission received the request for information because the requestor, who represents

the family of the deceased inmate, sent a letter to LaSalle, who is contracted with the county,
requesting certain documents be retained. The county also states lawsuits against LaSalle
often include legal claims against the Sheriff of Bowie County and/or the county directly.
However, upon review, we ?nd the county has not demonstrated any party had taken
concrete steps toward ?ling litigation against the county when the request was received.
Thus, we conclude the county has failed to demonstrate it reasonably anticipated litigation
when it received the request for information. Therefore, the information may not be withheld
under section 552.103(a) of the Government Code.
Section 552.101 of the Government Code excepts from disclosure ?information considered
to be con?dential by law, either constitutional, statutory, or by judicial decision.?' Gov?t
Code 552.101. Section 552.101 encompasses information made con?dential by the
Medical Practice Act subtitle of title 3 of the Occupations Code, which governs
release of medical records. Section 159.002 of the MPA provides, in relevant part, the
following:
A communication between a physician and a patient, relative to or in
connection with any professional services as a physician to the patient, is
con?dential and privileged and may not be disclosed except as provided by
this chapter.
A record of the identity, diagnosis, evaluation, or treatment of a patient
by a physician that is created or maintained by a physician is con?dential and
privileged and may not be disclosed except as provided by this chapter.
A person who receives information from a con?dential communication
or record as described by this chapter, other than a person listed in
Section 159.004 who is acting on the patient?s behalf, may not disclose the
information except to the extent that disclosure is consistent with the
authorized purposes for which the information was ?rst obtained.
Occ. Code Information subject to the MPA includes both medical records
and information obtained from those medical records. See id. 159.002, .004. This of?ce
has concluded the protection afforded by section 159.002 extends only to records created by
either a physician or someone under the supervision of a physician. See Open Records
Decision Nos. 487 (1987), 370 (1983), 343 (1982). We have marked documents created by
a nurse. The commission must only withhold these documents if they were created under the
supervision of a physician. If the documents created by the nurse were not created under the
supervision of a physician, the documents are not subject to the MPA and the commission
may not withhold them under section 552.101 on that basis.
'The Of?ce of the Attorney General will raise mandatory exceptions on behalf of a governmental body,
but ordinarily will not raise other exceptions. See Open Records Decision Nos. 481 (I987), 480
(1987), 470(1987).

Section 552.101 of the Government Code also encompasses laws that make criminal history
record information con?dential. CHRI generated by the National Crime
Information Center or by the Texas Crime Information Center is con?dential under federal
and state law. CHRI means ?information collected about a person by a criminal justice
agency that consists of identi?able descriptions and notations of arrests, detentions,
indictments, informations, and other formal criminal charges and their dispositions."
Id. 41 Part 20 of title 28 of the Code of Federal Regulations governs the release
of CHRI obtained from the National Crime Information Center network or other states.
See 28 CPR. 20.21. The federal regulations allow each state to follow its individual law
with respect to CHRI it generates. Open Records Decision No. 565 at 7 (1990).
Section 411.083 of the Government Code makes CHRI the Texas Department of Public
Safety maintains con?dential, except DPS may disseminate this information as
provided in subchapter or E-l of chapter 411 of the Government Code. See Gov?t Code
411.083. Sections and 411.089(a) authorize a criminal justice agency to
obtain CHRI. However, a criminal justice agency may only release CHRI to another criminal
justice agency for a criminal justice purpose. Id. Thus, CHRI obtained
from DPS or any other criminal justice agency must be withheld under section 552.10] of
the Government Code in conjunction with subchapter of chapter 411 of the Government
Code. We note Federal Bureau of Investigation numbers constitute CI-IRI generated
by the FBI. Upon review, we ?nd the information we have marked under chapter 411
constitutes con?dential CHRI. Therefore, the commission must withhold this information
under section 552.101 of the Government Code in conjunction with chapter 411 of the
Government Code and federal law.
Section 552.1175 of the Government Code may be applicable to some of the remaining
information. Section 552.1175 protects the home address, home telephone number,
emergency contact information, date of birth, social security number, and family member
information of certain individuals, when that information is held by a governmental body in
a non-employment capacity and the individual elects to keep the information con?dential.
See id. 552.1175. We note section 552.1175 is also applicable to personal cellular
telephone numbers, provided the cellular telephone service is not paid for by a governmental
body. See Open Records Decision No. 506 at 5-6 (1988) (section 552.1 17 not applicable to
cellular telephone numbers paid for by governmental body and intended for of?cial use).
However, we note section 552.1175 does not apply to an individual?s work telephone
number. Some of the remaining information pertains to an individual who may be subject
to section 552.1175. Accordingly, to the extent the information at issue, which we have
marked, relates to an individual who is subject to section 552.1175(a) and who elects to
restrict access to the information in accordance with section the commission
must withhold the information under section 552.1175 of the Government Code; however,
to the extent the information is a cellular telephone number, it may only be withheld only if
a governmental body does not pay for the cellular telephone service. Conversely, if the
individual whose information is at issue is not an individual who is subject to
section 552.1 175(a) or does not elect to restrict access to his information in accordance with
section 552.1175(b) this information may not be withheld under section 552.1175.

In summary, to the extent the documents we marked were created under the supervision of
a physician, the commission must withhold this information under section 552.101 of the
Government Code in conjunction with the MPA. The commission must withhold the
information we marked under section 552.101 of the Government Code in conjunction with
chapter 41 1 of the Government Code and federal law. To the extent the information at issue,
which we have marked, relates to an individual who is subject to section 552.1 175(a) and
who elects to restrict access to the information in accordance with section the
commission must withhold the information under section 552.1 175 of the Government Code;
however, to the extent the information is a cellular telephone number, it may only be
withheld only if a governmental body does not pay for the cellular telephone service. The
commission must release the remaining information.
This letter ruling is limited to the particular information at issue in this request and limited
to the facts as presented to us; therefore, this ruling must not be relied upon as a previous
determination regarding any other information or any other circumstances.

On July 19, 2015 at approximately 1644 hours, Sabbie was brought to the Bowie Co. Jail for
Assaulting a Family Member. On July 21, 2015 at approximately 1615 hours, Sabbie was
being escorted back from Arkansas District Court Sabbie was a Texarkana, Arkansas offender
being held in the Bowie Co. Texas Jail). When the jailer and HM Sabbie reached the passage way
between Zone One and Zone Two, Sabbie stopped and refused to comply with the escorting
of?cer?s instructions and resisted being handcuffed. As a result of UM Sabbie re?lsing to submit
to restraints, the of?cer administered a blast of 2% Oleoresin Capsicum (pepper spray) to gain
compliance Sabbie was taken directly to the unit infirmary where he was examined by the unit
Program Specialist Lee Bailey reviewed all submitted paperwork to ensure compliance with
minimum jail standards. After careful review of all paperwork, it was determined that there was
mark as required by minimum jail standards and a notice of non-compliance was issued.

On 21 July 2015 at approximately 16:15 Mr. Michael Todd Sabbie, a Texarkana Arkansas Offender, ID
No.: 175838, charged with assaulting a family member, was being escorted back from Arkansas District
Court. When the officer and offenders reached the passage way between zone two and zone one, Mr.
Sabbie stopped and refused to comply with the escorting officers? instruction and resisted being
handcuffed. Mr. Sabbies? resistive behavior lead to the use of physical force and the use of 2 OC
(Oleoresin Capsicum) to gain his compliance. Escorting Officers escorted Mr. Sabbie to the unit infirmary
where he was examined by the unit nurse and found to have suffered no injuries due to the use of force.
Mr. Sabbie was escorted to Pod, where he was placed in the shower and then in Cell L?l. He was given
a towel to dry himself. According to the staff they went back to Mr. Sabbies? cell and gave him 3 Use of
Force Participant Statement and took still picture of Mr. Sabbie as required by the use of plan.
According to Housing Officer Simone Nash, who came on duty at 7:00 pm, statement she observed Mr.
Sabbie throughout the night laying on the floor and could see respiratory breathing but did not get a
verbal responsible. At approximately 01:28 Officer Nash stated when she checked Mr. Sabbie, she called
his name, she heard a grunt from the cell. At approximately 06:10 Officer Nash and Officer Anna LaFieur
entered L-Pod to gather the empty morning food trays. Officer LaFieur states she went to Cell L-1 and
observed Mr. Sabbie lying on the floor with his jail pants down passed is groin area. When she instructed
Mr. Sabbie to cover himself she received no response. She then notified Sergeant Daniel Hopkins. When
the staff entered the cell they reported that they could not get a response from Mr. Sabbie and the unit
nurse was call and started CRP. Life Net Emergency Responders were call and responded but were
unable to revive Mr. Sabbie. Mr. Sabbie was pronounced dead at 06:42. The Texarkana Arkansas Police
were call and began an investigation. The body of Mr. Sabbie was removed by the Police and Miller
County Arkansas Coroner and the body sent to the State Crime Lab for autopsy.

It is and has been the policy of the Bowie/Bi State Jails that each employee charged with the
responsibility of inmate supervision or care shall conduct irregular documented face to face housing
observations/security checks of inmates according to unit post orders, security and medical procedures,
and as directed by Chapter 275 of the Texas Jail Standards.
It is the responsibility of the Chief of Security, Operation Captains and Lieutenants, and Shift Lieutenants
and Sergeants to have sufficient staff on duty to fulfill this task. These staff members are directed and
required to make unannounced and irregular document checks of each housing unit no less than twice
per shift.
The Unit Compliance Officer is directed to make unannounced and irregulars checks of the housings and
support department checking employee and documents for Standards Compliance. His or Her findings
are reported to the Warden and Assistant Warden for any needed corrective action.
Each On Coming Housing Officer should be provided with a list of inmates assigned to his/her assigned
area to assist the officer in accountability and identifying the inmates assigned to that cell, Pod or Zone;
and a copy of Post Orders and the Daily Building Schedule to direct their daily activities.
Procedure:
General Housing:
Housing Officers are instructed to make irregular documented face to face observations/security checks
of inmates assigned to general population minimum, or medium housing areas or zones at intervals not
to exceed 60 minutes. These irregular documented observatioris/security checks are to be completed in
irregular thim (30) minute intervals and supervisors are expected to take into account the need for
additional assistance to complete this task, and assign assisting staff as necessary.
Maximum/Special Housing:
Housing Officers assigned to Close Custody or Special Housing make irregular documented face to face
observations/security checks of inmates assigned to these areas at irregular times not to exceed thirty
minutes. This includes the following inmates, but not limited to: inmates with a maximum custody
classification; inmates in need of protective custody; inmates known to be assaultive; inmates who are
mentally ill; inmates who demonstrate bizarre behavior; and inmates on disciplinary rest?cE??EWED

lnmate who have demonstrated potential suicidal behavior are placed on special medical watch at
irregular documented face to face observations. At intervals as directed by the medical staff at intervals
to include direct and continuous supervision, 15 minute observations, or thirty minute observations.
Documentation:
Documentation of face to face observations/security checks are to be completed on the appropriate
form, at irregular times, and the completed form turned in to the shift supervisor at the end of each
shift or maintained in the housing log book. The Shift Supervisor is to review each form or log book for
completeness, compliance, and accuracy. Completed forms and log books are then reviewed by
Operations Captain. Upon completion of his/her review the Compliance Officer will review and file.
Corrective Action:
Based on our investigation Officer Nash failed to follow her post orders and training. Her post orders
directed her to make no less than thirty minute checks during her shift and based on her statement and
review of the in-house video, she made six. To ensure that the staff follow the procedures and post
orders for their assigned duty, in-service training is being scheduled for all correctional staff to insure
that they understand the procedures that are in place, the importance of making face to face
observations, the importance of properly documenting of what they do and see, and what the result will
be should they fail to comply with these procedures.

Warden Bowie County Correctional Center/Bi-State Detention Center
To specify the duties of the Of?cer assigned to Zone Two, Cells securing inmates and their activities and to ensure the order
and security of the facility.
The Officer assigned to duty on a speci?c shift shall be present for shift
brie?ng 15 minutes before shift change.
The Of?cer shall be properly groomed and in full uniform.
The Officer shall receive his/her duty assignment from the shi? supervisor
and shall receive special instructions relative to that shift.
Upon assuming the duties at Zone Two. the Of?cer shall verify the inmate
count for Zone Two with the Of?cer being relieved.
The Of?cer shall exchange any information that may be vital to the order
and security of that station and the facility.
The Of?cer coming on duty shall then make the following entry in the
station logbook; have assumed all?duties as ?oor Of?cer for Zone Two,
the inmates cell count is as follows: list cell blocks and assigned inmate in
and out count along with the total inmate count per cell.
The Of?cer shall then make a log entry verifying his/her reading of the
post orders.
The Of?cer?s primary duty is to ensure the security and safety of the
Of?cers and inmates assigned to Zone Two, Cells J. K. L, M. and N.
The Of?cer shall also assist and direct the inmates in their daily activities
and assignments.
The Of?cer shall ensure that inmate sanitation workers have ample
cleaning supplies to issue to each cell and to complete his assigned duties.
The Officer shall inspect cells to ensure that all cells are clean and in order,
and accompany the Sanitation Of?cer during morning inspection of inmate
quarters, completing any instructions issued by the Shift Supervisor.
The Of?cer shall ensure that all inmates receive a tray if feeding is
conducted in the cell, or if required, allow each inmate the opportunity to
go to the chow hall.
The Of?cer shall ensure that all inmates that are scheduled for recreation.
school, work, medical, classi?cation, church, etc. are advised of the
activity in advance to be ready to exit the cell at the speci?ed time. and all
inmates are fully dressed, properly groomed, before exiting their cell.

The Of?cer shall make rounds of Zone Two at approximately thirty?minute
intervals, checking cells for cleanliness. inmate welfare etc.. and keep
inmate movement to a minimum at all times, and coordinated with the
Shift Supervisor.
The Of?cer shall conduct formal counts when count time is called ensuring
that all inmate movement stops during count time. and conduct informal
counts throughout the shift at random times and complete all headcount
sheets and submit to Book?In.
The Of?cer shall pat search the inmates upon return to their Zone or cell
and also may conduct random pat searches of inmates walking the halls at
the Of?cer?s discretion.
The Of?cer shall call 10-] 0 at their assigned Zone, a Supervisor, and the
hand held video camera. and order the inmates to stop in the event of a
?ght involving inmates. Once the Supervisor, camera, and additional
Of?cers arrive. enter the cell to break up the ?ght.
The Of?cer shall assist other Of?cers in the performance of their duties.
and complete any duties assigned to them by the Shift Supervisor.
The Of?cer shall not enter the control room for any reason unless approved
by the Shift Supervisor.
The Of?cer shall not leave their assigned Zone without permission unless
approved by the Shift Supervisor.
The Officer shall log all activities during the shift for the assigned Zone in
the Zone Book.
The Officer shall have knowledge of Fire and Safety plans and Evacuation
procedures.
The Of?cer will complete all reports and paperwork for any incidents that
accrued before going off duty and leaving the facility.
The Of?cer shall escort inmates to and from court and medical.
The Of?cer must remain on post until properly relieved by the oncoming
Of?cer.
Of?cer shall never enter Cell without another Of?cer or Supervisor
present.
Must have a working knowledge of the facility policies and procedures. as
well as the Texas Jail Standards.
Must check the identity of all inmates being released from the facility.

Face to Face Observations
Face to Face has the following means: 1. to make face to face contact, and 2. to
be in the present of and view of.
Assigned staff are to make physical face to face observations of inmates in their
assigned areas of responsibility and document the time these observations are
made and observed inmate activity. This maybe waking an inmate assigned to
special housing up at an in convent time.
Time Requirements
Irregular Times has the following meaning: observations not to be made at the
same time.
All staff are required to follow the instructions in the jail standards, facility
operations and medical procedure, and post orders.
Checks cannot exceed the establish time limits for the assigned observation and
have been set to be completed at irregular intervals; 1. continuous documented
every 5 minutes; 15 minutes; 20 minutes; and thirty minutes.

CHAPTER 375 SUPERVISION OF INMATES
RULE ?27S.l Regular Observation by Corrections Of?cers
Every facility shall have the appropriate number of jailers at the facility 24 hours each day. Facilities
shall have an established procedure for documented, face-to-face observation of all inmates by jailers
no less than once every 60 minutes. Observation shall be performed at least every 30 minutes in
areas where inmates known to be assaultive. potentially suicidal, mentally ill, or who have
demonstrated bizarre behavior are con?ned. There shall be a two-way voice communication
capability between inmates and jailers, licensed peace of?cers. bailiffs, and designated staff at all
times. Closed circuit television may be used, but not in lieu of the required personal observation.

CHAPTER 275 SUPERVISION OF INMATES
RULE ?275.4 Staff
inmates shall be supervised by an adequate number of jailers to comply with state law and this
Chapter. One jailer shall be provided on- each- ?oor- of the facility where 10 or more inmates are
housed, with no less than 1 jailer per 48 inmates or increment thereof on each ?oor for direct inmate
supervision. This jailer shall provide documented visual inmate supervision not less than once every
60 minutes. Suf?cient staff to include supervisors, jailers and other essential personnel as accepted
by the Commission shall be provided to perform required functions; A plan concurred in by both
commissioners? court and sheriffs of?ce, which provides for adequate and reasonable staf?ng of a
facility, may be submitted to the Commission for approval. This rule shall not preclude the Texas
Commission on Jail Standards from requiring Staf?ng in excess of minimum requirements when
deemed necessary to provide a safe. suitable, and sanitary facility nor preclude submission of
variance requests as provided by statute or Chapter 299 of this title.

CHAPTER 273 HEALTH
RULE ?273.6 Restraints

Inmates exhibiting behavior indicating that they are a danger to themselves or others shall be
managed in such a way as to minimize the threat of injury or harm. If restraints are determined to be
necessary, they shall be used in a humane manner, only for the prevention of injury, and not as a
punitive measure.
(I) The decision to apply restraints shall be made by supervisory or medical personnel. Appropriate
staff should assess the inmate's medical condition.
(2) Restraints should restrict movement of an inmate only to the degree necessary to avoid injurious
behavior. Soft or padded restraints should be used when feasible. Inmates shall not be restrained in a
position or manner that would exacerbate any physical in?nnities.
(3) A documented observation of the inmate shall be conducted every [5 minutes, at a minimum.
The observations should include an assessment of the security of the restraints and the circulation to
the extremities.
(4) The inmate should receive medical care a minimum of every 2 hours, to include changing
position, exercising extremities, otfering nourishment and liquids, offering toilet facilities, checking
for medication needs, and taking vital signs. These checks shall be documented.
(5) Documentation of use of restraints shall include, but not be limited to the following: the events
leading up to the need for restraints, the time the restraints were applied, thejustifrcation for their
use. observations of the inmate's behavior and condition, the 15-minute checks and the time the
restraints were removed.
6) Documentation of use of restraints during labor, delivery and recovery for known pregnant
inmates shall include, but not be limited to the following: the events leading up to the need for
restraints, the time the restraints were applied, the justification for their use, observations of the
inmate's behavior and condition and the time the restraints were removed.
(7) Restraints shall be removed from an inmate at the earliest possible time that the inmate no
longer exhibits behavior necessitating restraint. In no case shall an inmate be kept in restraints longer
than 2.4 hours.

The body was that of a well-developed, well-nourished, obese, black male, received clad in a
pair of red pants. Taped over both hands were brown paper bags. The body weighed 152 kg
(334 pounds), had a length of 196 cm (77 inches), and appeared consistent with the reported age
of 35 years. The body was cool. Rigor was present and equal in all extremities. Lividity was
faint red-purple and fixed on the posterior surface of the body, except in areas exposed to
pressure. The scalp hair was black, curly, and short. The decedent wore a thin mustache and had
a goatee, with facial stubble in the remaining beard areas. The irides were unremarkable and the
pupils were equal at 4 mm in diameter. The corneae were clouded. The conjunctivae and
sclerae had congestive changes without petechiae or icterus. The external nares and lips were
unremarkable. The teeth of the lower alveolar ridge were natural and in good condition. The
upper alveolar ridge had many teeth absent, and the ones remaining were natural and in poor
condition. The auricles of the ears were unremarkable and the external auditory canals were dry.
Examination of the neck revealed no evidence of injury. The chest was unremarkable, with no
external evidence of injury of the ribs or sternum. The abdomen was obese, with no acute
injuries noted. The external genitalia were those of a normal adult male, without injuries. The
upper and lower extremities were well developed and symmetric, without edema or loss of
digits. On the arms were tattoos. No apparent needle tracks or wrist soars were noted. The
spine appeared to be intact by external examination. The anus was patent. The posterior surface
of the body was symmetric.
On the chest were two attached defibrillator pads. On the chest and abdomen were four attached
heart monitor pads.
Scattered across the anterior aspect of the abdomen were multiple, minute, healing and
well-healed scars. Within an area of the ventral aspect of the right forearm were multiple,
irregular, well-healed scars. On the ventral radial a5pect of the left forearm was a 0.5 cm, white,
esohar formation.
On the right posterolateral lower aspect of the back was a 4 cm, elongated, faint, discontinuous,
purple-blue contusion, with irregular red-brown abrasion. Reflection of the scalp revealed an
approximately 11 cm area of galeal contusion, located at the right posterior aspect of the scalp.
No associated skull fracture, bleeding around the brain, or cerebral contusion was identi?ed.
Close examination of the forearms revealed no abrasions, contusicns, or handcuff imprints.
INTERNAL EXAM
The subcutaneous fat layer of the abdomen measured up to 8 cm. No adhesions or abnormal
collections of fluid were present in the pleural or peritoneal cavities. Petechiae were not present
on the thoracic organs. All body organs in t?e? normal anatomic positions.

The pericardial and epicardial surfaces were smooth, glistening, and unremarkable. The
pericardial sac contained a normal amount of serous fluid and was without adhesions. The 815
heart was markedly enlarged in. size, with a normal shape and con?guration. The coronary
arteries arose normally, followed the usual distribution, and had mild to moderate atherosclerotic
changes. All of the. atherosclerotic plaques in the coronary arteries were crescent-shaped on
cross section of the arteries. Maximum luminal narrowing in the coronary arteries were 40% in
the Ie? anterior descending, 20% in the right, and 10% in the le? circum?ex. None of the
coronary arteries had evidence of thrombosis. Examination of the chambers and valves revealed
a normal size?position relationship, with normal endocardial surfaces, chordae tendineae,
papillary muscles, and valve lea?ets. The myocardium of the ventricles was dark red?brown,
with increased thickness of the left ventricular free wall and the interventricular septum. In the
myocardium were three dark red discolorations, none of which measured greater than 0.7 cm,
and were located in the lateral aspect of the left ventricle near the apex of the heart, in the
poste'rolateral aspect of the left ventricle near its mid aspect, and in the endocardial region of the
anterior aspect of the intraventricular septum near the base of the heart. The atrial and
ventricular septa were intact. The aorta and its major branches arose normally, followed the
usual course, and were widely patent, free of signi?cant atherosclerosis and other abnormality.
The vena cava and its major tributaries returned to the heart in the usual distribution and were
free of thrombi.
The 865 right and 760 le? lungs had smooth, glistening pleural surfaces. The pulmonary
arteries were normally deveIOped and patent, without thrombus or embolus. In the larynx and
trachea was mild froth deposition on the luminal surfaces. The airways were otherwise clear of
debris and foreign material, and had mucosal surfaces that were smooth and of normal
coloration. The pulmonary had prominent dark red?purple, mottled, dependent
congestion, and diffiJse edema. No speci?c focal lesions were noted.
NECK:
Examination of the soft tissues of the neck, including strap muscles, thyroid gland, and large
vessels, revealed no abnormalities or hemorrhage. The hyoid bone and larynx were intact. The
cpiglottis and vocal cords were unremarkable.
The tongue was without evidence of recent injury. The esophagus was lined by gray-white,
smooth mucosa. The gastric mucosa was arranged in the usual rugal folds, and the lumen
contained approximately 50 mL of brown fluid. The small and large intestines were
unremarkable and the colon contained formed stool. The rectum and anus were unremarkable.
The appendix was present.

The 2380 liver had a smooth, glistening, intact capsule, covering red-brown, ?rm
with a nutmeg pattern of passive congestion to the cut surfaces of the No Focal
lesions were noted. The edges were sharp. The gallbladder contained a scant amount of green
bile. The mucosa was velvety and unremarkable. The extrahepatic biliary tree was patent,
without evidence of calculi. The 205 pancreas was gray-tan, firm, and lobulated, with patent
ducts.
The 175 right and 195 left kidneys had thin renal capsules that stripped with case from the
underlying, roughly-granular, moderately-?rm cortical surfaces. The red-brown
cortices were sharply delineated from the red-purple medullary pyramids. The calyces, pelves,
and ureters were unremarkable. The urinary bladder contained approximately 200 mL of yellow
urine. The mucosa was gray-tan and smooth. The prostate and testes were unremarkable.
The thymus was identi?ed and composed of fat. The 240 spleen had a smooth, intact capsule
covering red-purple, moderately-?rm with prominent white pulp. No
accessory spleen was identi?ed. Regional nodes were not enlarged.
The pituitary, pineal, thyroid, and adrenal glands were free of obvious disease.
Muscles were red~brown and had normal development. No bone or joint abnormalities were
noted. The cervical. thoracic, and lumbar spine showed no obvious Fractures or other
abnormalities.
The scalp had ?ndings as previously described. The calvarium and base of the skull showed no
fractures. The dura mater and falx cerebri were intact. There was no epidural, subdural, or
subarachnoid hemorrhage present. The leptomeninges were thin, delicate, and clear. The 1445
brain had symmetric cerebral hemiSpheres, with typical gyri and sulci for the decedent's age.
The cranial nerves were intact. The circle of Willis and related blood vessels were normal in
caliber and distribution. Sections through the cerebral hemispheres, breinstem, and cerebelhun
revealed no focal lesions or herniation. The Spinal cord was not examined.

HISTOLOGY:
Heart and vessels: Six sections of ielt ventricle and interventricuiar septum had vascular
congestion and frequent hypertrophied myocytes with enlarged nuclei. Three of the sections
contained the areas of red seen grossly, which consisted of areas of dense ?brosis containing
prominent ncovascularization. The other sections had extensive areas of mild to moderate,
perivascular and interstitial ?brosis. No evidence of acute ischemia or signi?cant in?ammation
was identi?ed.
Lung: Five sections of long had vascular congestion and numerous, scattered alveolar
macrophages with dark brown cytoplasmic pigment. Occasional multinucleated giant cells with
similar brown cytoplasmic pigment were also present in the alveoli. Iron stains of the sections
revealed the brown pigment to be positive for iron, which was consistent with hemosiderin. No
significant in?ammation was identi?ed.
Liver: A section of liver had prominent congestion of sinusoids, and mild chronic in?ammatory
cell in?ltration of the portal triads, with no signi?cant steatosis.
Pancreas: A section of pancreas had diffuse loss of hematoxylin staining and cellular details,
consistent with autolysis. The glandular had mild adipose tissue in?ltration. No
signi?cant inflammation or ?brosis was identi?ed.
Spleen: A section of spleen had congestion of the red pulp and vessels, and infrequent germinal
centers of the white pulp.
Kidney: A section of kidney had vascular congestion, occasional small subcapsular cortical foci
of interstitial fibrosis with associated mild to moderate chronic inflammatory cell in?ltration and
globally?sclerotic glomeruli, and mild variable intimal thickening of artery walls.
Brain: A section of cerebrum from the region of the hippocampus had vascular congestion, with
no signi?cant in?ammation or evidence of ischemia.
Pituitary gland: A section of pituitary gland had vascular congestion. Both anterior and
posterior lobes of gland were present in the section. A vessel adjacent to the gland had an
intimal layer of dense ?brous atherosclerosis, with less than 50% narrowing of the lumen.
Pineal gland: A section of pineal gland had vascular congestion with a typical glandular
con?guration of cells and a few corpora arenacea.

OPINION:
This 35-year?old, black male, Michael Sabbie, died of hypertensive arteriosclerotic
cardiovascular disease.
The agencies responsible for investigation of this death were the Texarkana Police Department
and the Miller County Coroner's Of?ce, who reported that the decedent had been arrested on July
19, 20.15. He was transported to the bi-state jail, which is on the state line between Arkansas and
Texas. Two days later, on July 2), 2015, at 4:15 PM, the decedent was transported from the
booking desk to a jail cell, when he began refusing to cooperate with jail staff. Jail statf gained
control of the decedent through physical force by bringing him to the ground and then using a
burst of pepper spray. The decedent was restrained with handcuffs, checked out by the nurse,
and then taken to the showers to rinse off the pepper spray. While in the showers, the decedent
sat or fell down, and then was picked up. He was placed in a single jail cell. While attempting
to serve the decedent breakfast the next morning on July 22, 2015, the decedent was found to be
expired. He was pronounced dead at the scene by the Miller County Coroner. It was reported
that the decedent complained of shortness of breath (SOB) both before and a?er the physical
altercation on July 21, 2015.
An autopsy revealed a well-developed, well-nourished, obese, black male, who had a small
abraded contusion (scraped bruise) on the right side of his back. Re?ection of his scalp revealed
a contusion on the right backside of his head. There was no skull fracture or damage to the brain
identified in association with the scalp contusion. Internal examination of the body revealed a
markedly enlarged heart at 815 g, which is .o?en the result of long-term hypertension (high blood
pressure). There was mild to moderate coronary artery disease. Sectioning the heart Imuscle
revealed three areas of red discoloration within the heart muscle, which microscopically revealed
areas of dense ?brosis with numerous blood vessels, which gave them the red color. These areas
were consistent with old heart muscle damage. Additional mild to moderate ?brosis was present
throughout the heart sections. The kidneys had a granular surface, consistent with a diagnosis of
arteriolonephrosclerosis, which is also the result of long-term hypertension. The lungs had
edema and congestion. Sectioning the liver revealed a pattern consistent with passive
congestion. No other signi?cant gross or microscopic ?ndings are identified. A test of the blood
for volatiles was negative for alcohol, but did show a trace amount of acetone, which may have
been produced endogenously. A drugs-of~abuse screen of the blood was negative.
The autopsy revealed severe heart disease with evidence of at least two prior episodes of heart
muscle damage, indicated by various ages of ?brosis in the heart, and one or more past episodes
of congestive heart failure. These ?ndings, along with the report that the decedent had shortness
of breath prior to the altercation, and that the decedent did not expire during the altercation,
suggests that the altercation played a minimal role in the decedent's death, and may not have
contributed at all to his death. Due to this, the altercation was not considered as contributing to
the cause of death, and therefore, the manner of death was classified as natural.
