APIS/Notice of Arrival Although it is true that the eAPIS is not required, the APIS final rule which was implemented in 2009 does state that the Notice of Arrival must be filed electronically for private aircraft transiting from the United States Virgin Islands to the continental United States. The only electronic portal approved by CBP which can be used to electronically transmit the Notice of Arrival is the eAPIS website. Though you have been told in the past that you have to do an eAPIS, I believe the correct term they should have used was the electronic Notice of Arrival. Please note that APIS regulations do not apply to flights between the United States and the U.S. Virgin Islands, Puerto Rico, Guam, or the Commonwealth of the Northern Mariana Islands, as these locations are considered part of the United States for APIS purposes. However Notice of arrival requirements previously in place for flights from the U.S. Virgin Islands still apply and can be found in Title 19 of the Code of Federal Regulations, section 122, subpart N. This will serve as the electronic notice of arrival/departure and traveler manifest submission. CBP recommends that the pilot keep a printed copy of the manifest. Notices of arrival or departure submitted outside the eAPIS web portal or other CBP approved electronic data interchange system do not satisfy electronic manifest submission requirements.
