I had the opportunity to discuss with CZM the concerns you raised in our meeting last week Friday. I looked into the
following issues:
1)
The flagpole height
2)
Burying of brush
3)
Designation of the islands as a sanctuary
4)
Bike path to conduct patrols
I am confident that the staff provided your team with the proper explanations and guidance to move forward with all of
the above issues. Your attorney was given a full explanation of the flagpole height limitation. Title 29 VIC Section 226(1)
provides the guidance for the generous 45 height limitation. Also, the burying of the brush is possible. You need to
submit a plan to CZM for approval. Director Oriol communicated with your attorney regarding the nearby bird sanctuary
and CZM's responsibility to consider potential impacts of projects on the island. CZM is not stating that the islands itself
is a sanctuary. Finally, you would also need to submit a plan for approval, as part of your project for the bike path.
As your team moves forward with the permitting process, CZM will remain available to assist in working through these
issues. It was a pleasure meeting you and your attorney.
