In fact he refused to give me any input into his th=ughts at all, except that he would be willing to speak about the successor=trustee issue with either Max or his own counsel on the phone. I got the distinct impression that he has made=little progress on finding his own counsel as he mentioned that a discussi=n with his own counsel would need to wait until January. I asked Harry to consider naming Richard as the succ=ssor trustee on the basis that Richard is a trustee with a great deal of e=perience, he has your trust, and he is a permitted independent trustee acc=rding to the terms of the trust. If we are to make progress on finding a successor to=Max we need to either a) have a call with Max and Harry early next week; b= your daughters need to agree to remove both Max and Harry and leave the a=pointment up to you; or c) institute a court action for removal. I do not think we should wait until Harr= finds his own counsel. I do not think we should institute a court a=tion until we get the list of potential successor trustees from Max and ha=e had a chance to review it together.
