If all or any part of payment for the labor, parts. materials, supplies, components. appliances, fuel and work is to be made by credit card. Banyan is hereby granted limited power of attorney, and is hereby expressly authorized. to charge the credit cards(syaccount(s) Identified above, or otherwise provided, in such amounts, and at such times. as may be necessary to ensure prompt and complete payment in full for all labor, parts, materials, supplies. components. appliances. fuel and work. In the event that payment is not made when billed. Banyan may cease or suspend repairs/services and shall not thereby be liable for any delay in return of the aircraft to service. nor be liable for any other damages for loss of use of the aircraft or other/me to the owner thereof or any person. firm or entity claiming by, through or under owner. The outstanding balance due shall be subject to a finance charge of 1'4% per month, together with a parking/storage charge at the then prevailing rates in effect for the type of aircraft until payment in full has been received. In order to secure payment for all labor, parts, materials, suppfies, components. appliances, fuel and work. in addition to the foregoing. Banyan Air Services. Inc. is hereby granted an express mechanics lien on the said aircraft in accordance with the provisions of §§329.41, 329.51 and Ch. 713, Part II, Fla. Stets. Banyan is hereby granted the continuo°, irrevocable and consensual right to record and foreclose a lien against the said aircraft in the event any biN for maintenance. repairs, labor, pads, materials, supplies, fuel, lubricants ancUor other services is unpaid and any requirement that Banyan possess the aircraft is expressly and irrevocably waived and renounced. Banyan is expressly authorized to record and foreclose any such hen. and Banyan is not required to possess the aircraft at the time of filinglrecording of any such lien. Lack of possession of the aircraft shall not be a defense to the enforcement of any such lien, which shall be deemed to be a valid and incontestable lien against the said aircraft (notwithstanding any provision of law to the contrary). In the event that it becomes necessary for Banyan to employ the services of an attorney to enforce its rights hereunder or to collect any balance due. the owner of the said aircraft shall pay all court costs and attorney fees incurred by Banyan in addition to any principal and interest adjudged to be due Banyan.
