IN THE CIRCUIT COURT OF THE 17TH JUDICIAL CIRCUIT IN AND FOR BROWARD COUNTY, FLORIDA CIVIL DIVISION CASE NO.: CACE 15-000072 BRADLEY J. EDWARDS and PAUL G. CASSELL, Plaintiffs, vs. ALAN M. DERSHOWITZ, Defendant. AGREED ORDER APPOINTING COMMISSIONER IN COLORADO This cause comes before the Court on Defendant's Motion to Appoint Commissioner in the State of Colorado. Having carefully considered the same, being advised of agreement between counsel and finding good cause shown, it is hereby, ORDERED AND ADJUDGED that Defendant's Motion to Appoint Commissioner is hereby GRANTED. Commission is issued by this Court to Esquire Deposition Solutions for the examination, under oath, of Jane Doe #3, who is located in the state of Colorado, to record testimony, secure documents, and report and transcribe same from such deposition. The deposition will be taken in or near Canon City, Colorado, or such other place as the parties and witness agree. The Commission is directed to Esquire Deposition Solutions or such other registered court reporters authorized to administer oaths under the laws of the State of Colorado. As for the respective parties herein, all are hereby authorized and allowed to attend before such commissioner and orally examine and cross-examine such witness as is properly noticed for deposition and/or subpoenaed. EFTA00608960 The commission will respectfully insert in the deposition all of the questions put to the witness, the answers thereto by the witness, and the documents produced pursuant to process. If either party desires, the deposition may be videotaped. This Court requests the District Court in Fremont County, Colorado, and all Courts having jurisdiction of this witness, to issue a subpoena in conformance with the Florida deposition notice and this Order so as to mandate the witness's appearance at the time and place of the deposition and to produce any and all requested documents, subject to any proper objections to the production of documents that may be made.
