3. executive branch rules require an internal evidentiary process that precedes designation of individuals and
institutions.
4. courts have invariably upheld designations made consistent with that process.
I would say that the designation of some of the Russian plutocrats/Putin pals (Timchenko, Yakunin, the
Rotenbergs) is close to the edge of usual practice in these regards insofar as they do not seem to have been
involved directly or specifically in Crimea/Ukraine related bad behavior (at least I don't think the USG has
made that case publicly) but rather were cited for their close relationship, financial/political support to Putin
and others who were directly or specifically involved in that bad behavior. Their designation puts, or at least is
intended to put, pressure on/creates pain for the government officials responsible.
I think the analysis plays out along a continuum in terms of the designated persons nexus to bad behavior or the
extent to which designating them will advance US national security interests. Don't think the folks designated
are exactly "random." Doesn't strike me that President was even close to overstepping his authorities. Doesn't
trouble me from a principled perspective in an effort to put pressure on Putin and the G of Russia.
Of course, all of these programs, to some extent, leave the US vulnerable to reciprocal actions.
