THIS DOCUMENT IS PROTECTED BY THE ATTORNEY CLIENT PRIVILEGE AND/OR THE ATTORNEY WORK PRODUCT PRIVILEGE AND/OR THE INVESTIGATOR CLIENT PRIVILEGE To: Robert Critton / Michael Burman From: William Riley / Paul Lavery Date: August 4, 2009 Re: Epstein / / interview Barbara and Martie Rutledge File: 8577R On Tuesday, July 28, 2009, Investigator Paul Lavery interviewed Martie Rutledge and her daughter Barbara Rutledge concerning . The interview with Martie Rutledge was in person and the brief interview with Barbara Rutledge was by cell telephone contact. Barbara Rutledge was identified by Tiffany Avery as being a friend of and suggested Lavery interview Rutledge. Investigator Lavery contacted Martie Rutledge and another daughter (possibly Carol) in the driveway at Martie's home, Her daughter was literally stepping into in her vehicle and had children with her when Lavery approached. Upon introduction Martie Rutledge said Barbara had coincidently just left from her home about 15 minutes before Investigator Lavery walked up. It was learned Barbara Rutledge resides in the area and had been in town visiting for a few days. Martie Rutledge did not know the name of but the daughter did and said while starting her vehicle that she knew sister. This daughter was obviously not interested in the matter, closed the vehicle door and drove off. Martie Rutledge was very courteous and invited Investigator Lavery inside the house. She called Barbara on her cell telephone Barbara a private investigator was there asking about ) and told Martie then said "it has to do with some court case". Lavery could hear Barbara on the other end of then respond, "it must be about the Epstein case". RILEY KIRALY 5645 CORAL RIDGE DRIVE. #391. CORAL SPRINGS. She told Lavery she had gotten onto the Florida Turnpike heading north towards Orlando and was not able to return back to her mother's house. She said she in heavy traffic and it was determined Lavery would call her back the next day or so to complete the interview. Concerning a few brief questions addressed with Barbara before discontinuing the call, it was learned Barbara has seen or been with recently along with some other girls in a little "get to together" the last time she was in Palm Beach. It was within the last few months but as of this report unknown as to the exact date. Barbara stated appeared to be fine and not under any stress and there was nothing out of the concerning her behavior. Investigator Lavery has not yet had a chance to explore this with Rutledge but will if a second interview happens. Secondly, Rutledge said she was made aware of a few years ago of the police / FBI investigation relating to Jeffrey Epstein because told her of it. Rutledge said told her when the FBI or police, not sure which agency, had contacted concerning the investigation. Rutledge said she recalls telling , "just tell the truth and you'll be alright". As noted this call was relatively brief and therefore the inquiry did not reach beyond this limited introduction. However, it appears that on the surface at least Rutledge has some knowledge of the previous law enforcement investigation. It was left undetermined whether she is aware of the instant civil case(s). Note, Rutledge stated she was unaware of supposed recent suicide attempt as reported by PBSO. The result of on going efforts to complete a more thorough interview with Barbara Rutledge will be submitted upon completion. As of the writing Rutledge has not responded to phone calls or messages left for her. RILEY KIRALY 5645 CORAL RIDGE DRIVE. #391. CORAL SPRINGS. KIRKLAND & ELLIS LLP

KIRKLAND & ELLIS LLP SUMMARY OF MISCONDUCT ISSUES IN THE MATTER OF JEFFREY E. EPSTEIN The manner in which federal prosecutors have pursued the allegations against Mr. Epstein is highly irregular and warrants full review by the Department. While we repeatedly have raised our concerns regarding misconduct with the United States Attorney's Office in Miami (the "USAO"), not only has it has remained unwilling to address these issues, but Mr. Epstein's defense counsel has been instructed to limit its contact to the very prosecutors who are the subject of this misconduct complaint. For your review, this document summarizes the USAO's conduct in this case. Background 1. In March 2005, the Palm Beach Police Department opened a criminal investigation of Palm Beach resident, Jeffrey E. Epstein. The press has widely reported that Mr. Epstein is a close friend of former President Bill Clinton. 2. In July 2006, after an intensive probe, including interviews of dozens of witnesses, re
