The reason is that I have to make some adjustments to my schedule today if I am going to be in Miami and because they involve other people and travel schedules, I have to inform people today. The status conference is just that. It's a chance to give the judge a brief overview of this case. He will also have his initial perspective that he will want to share with the parties. EFTA00758282 From our perspective, we want him to understand that while we recognize that some money MAY be due to Podhurst, we have already paid half a million dollars and it may be that NO money is due. We are planning to move to dismiss at least part of the complaint. He will ask about settlement. About mediation. About appointing a magistrate to supervise the case. We will also have a chance, if we do things right, to explain to him briefly what the NPA is all about, how outrageous and coercive it was, and how the fee component has been used inappropriately. Again, I think you need to have someone handle this in Court who truly knows the history of the NPA and who is comfortable in Court. I expect Podhurst to try to piss all over you and prejudice the judge. And it is likely that your lawyer will have to do some pushing back - and point out, with one or two examples, how certain things they are billing you for, simply have to be outside the scope of the NPA. That said, this is a status conference, and there's no way to be sure the judge will allow much of that on either side. He may just want to talk about dates and deadlines. Please let me know today as I have to make plans and change other plans if I am going to be responsible for the status conferece. As I said, I think Marty would also be perfect to handle things. He knows the NPA and is very articulate on his feet. I think, however, that you have to rely on one person at the status conference. It's not a forum for a lot of back and forth.
