From: To: Richard Kahn "[email protected]" <[email protected]> Subject: RE: 301 remaining fee Date: Mon, 17 Mar 2014 19:43:13 +0000 Importance: Normal Dear Richard; I am rather surprised by your response advising that Jeffrey is dissatisfied with the way time, energy and money were spent on this project. Never in any of my conversations with Jeffrey or any of his employees was I told that he was dissatisfied, in fact, quite the opposite. In every conversation and meeting I was encouraged to continue the design process and in the end I provided exactly what Jeffrey requested, and what the terms of our contract required. Also, during this entire process, I have been very persistent in attempting to relay information to Jeffrey and his staff, often making numerous phone calls and emails weekly, before receiving replies, which of course delayed the process greatly. If anything, I am the one who has wasted time and energy, due to lack of response and action. As previously stated, I have thus far given Jeffrey all of the information and tools needed to completely renovate these apartments, fulfilling my end of the contract that we agreed upon. I have indeed put a lot of time and energy into this project, and the only way this will be wasted is if Jeffrey does not fulfill his end of our agreement and pay the balance owed in full. Again, I want to be sure you understand that I am more than willing to help complete this project should Jeffrey decide to proceed, however my fees for completed conceptual/schematic design and design development are owed to me, regardless of whether or not this project enters construction phase. If Jeffrey would like to discuss his dissatisfaction, I am always available to talk. Please send balance due of $15,000 for services rendered per our contract. The nonrefundable 15k was paid as a portion of the Conceptual / Schematic Design Phase so an additional 5k plus half of the Design Development Phase, 10k. A total of 15k is owed to me for work completed. Please have check cut and sent to the address below. You have all information that is required to go forward, including specifications, purchasing agents contacts and cost sheets, GC scrubbed proposals and finish specifications per apartment. Please let me know if you decide to proceed and I would be happy to continue work to get these apartments completed to your satisfaction. Best, EFTA00870584
