Date: Tue, 16 Oct 2018 04:36:20 +0000 Justin: Here is my rationale, which you can transmit to ASU once we talk tomorrow and once I have conferred with Jeffrey and Nancy, and the language I suggest, which of course you can adjust I accept the University's issues with the number of donors over many years. Here is what I propose: That only major donors be considered, and for ease of logistics we consider the following: (a) only donors in excess of $5K who donated or pledged funds since Jan 1, 2017—these funds will not have been expended and thus the total amounts should be available--I believe the total amount of these donations, from 10-20 donors at most, including pledges is less than $200K, (b) plus the unexpended funds for the Black Foundation, which I expect total about $1.1 M or so (I put donors in excess of $300K to limit it to Black Foundation) In order to preserve confidentiality, I do not feel it is necessary to name them in this agreement. The language I suggest is that given below. "If, in the next 60 days any of the following donors to the ASU Foundation to support the Origins Project makes a request to transfer funds (outlined below) to another nonprofit organization ASU will not opposed the transfer of funds and will request that the ASU Foundation make the requested transfer: (a) All funds from Major donors ($5000 and above-including amounts pledged and including multiple donations from a single family) since Jan 1, 2017, (b) unexpected funds from single major donors in excess of $300,000 since 2010. Professor Krauss will provide a list directly to the ASU Foundation of the donors that, to his knowledge, fall in this category, and the ASU Foundation will be solely responsible for confirming its validity, and if necessary reporting back to Prof. Krauss with names added or removed from this list. Only requests from these individuals or groups will be considered for transfer. It is expected that this list will include less than 20 donors, and based on the estimates available at the current time of ASU Foundation funds not expended as of Oct 2018, it is expected that the total available funds for this purpose will not be less than $1M, and not more than $1.3 M. However, the ASU Foundation shall be solely responsible for providing an accounting of the amount of funds available for transfer under this arrangement. " Note; we could change this to $2500 and above, in which case there will be about 25-40 donors.. let me know what you think.. I am in central time in Mexico. I will get up at around 7 am, and we can talk either at 8 am or at 11 am my time to finalize this.
