From: Valeria Chomsky To: "Jeffrey E." <jeevacation®gmail.com> Subject: Fwd: Meeting with Shari Levitan Date: Mon, 22 Jan 2018 23:19:24 +0000 I told Shari that is totally unfair to Noam at his age, at this stage of his life, that he has to deal with this situation -- he being treated as a senile and I being treated as a criminal. All we want is to live our life without interference. She mentioned that lawyers don't always have to do what their clients ask for. For example, if I would ask her for suing Max for defamation, she wouldn't do it. This when I mentioned that Max has been saying things about me that I would like if he would repeat them in court. I am so stressed with all these years, that I got too emotional at some points and couldn't control myself, unfortunately. I was afraid she had already drank the koolaid On Mon, Jan 22, 2018 at 11:49 PM, Valeria Chomsky > wrote: As you can see the meeting was a little adversarial towards me, as she was trying to show that the children are not wrong -- she also said that the money from the trust cannot come to me. And I said I am not expecting so. At some point, when I was trying to say something, she interrupted me and said: "may I continue?" And I told her: "not until I finish". I would say she is going to be very similar to Deborah, perhaps a little harder. She also asked Noam if his children and Max could claim that Noam is loosing his mind. Noam answered that there is no such possibility. She also mentioned that the loan can cause a bad surprise soon, since they might demand payment of principal and interests, as the money came from the trust and should go back to the trust, although the trustees could change the conditions totally or partially. But it is totally their decision. Release Max from all his wrong doing (?) But that's why he doesn't want to send a draft to Noam, but to Noam's lawyer, such as Deborah or Shari who would advise Noam to sign it to follow an amicable way and get the information that Noam needs. All crazy. ----- Forwarded message From: Jeffrey E. <[email protected]> Date: Mon, Jan 22, 2018 at 5:16 PM Subject: Re: Meeting with Shari Levitan EFTA01037636 To: Valeria Chomsky did you like her? how do you know what you are releasing him from, ? that is silly, without details On Mon, Jan 22, 2018 at 11:13 PM, Valeria Chomsky < In the meeting today: > wrote: Shari Levitan started the meeting saying that she knows about trusts not only from practice, but also academically, since she teaches about trusts. She also confirmed that Max talked to her as a possible trustee and, if not, to request some recommendations. 1) when I asked Shari if she would take the steps to have a litigation against Max, she answered that she would have to consider the situation and she would prefer to begin following an amicable way. 2) about the release from Max, she said that it is not unusual for a trustee to request a release. 3) she also said that a trustee should not only be involved in the trust issues, but in the beneficiary financial affairs at a very general level, not in detail. Also that money from the trust could be deposited in a separate account for specific purposes. 4) when I mentioned that Noam was the grantor of the marital trust, Shari said that the trust was not funded by Noam's money, but by Carol's Revocable trust, with money that Noam had given to Carol. Carol could have done whatever she wanted with the money. Therefore the children are right when they say it's their mother's money. 5) she also suggested that before Max steps down, we have to get an accounting of everything that has been done during his tenure as trustee, including information about the distributions that were made to non- beneficiaries without informing Noam and the payments that were supposed to be made to Noam regularly from income from the trust but which he was never informed about. She said the best way is to proceed amicably, since Max is legally obligated to do this, and if there is any problem, to take harsher steps. please note The information contained in this communication is confidential, may be attorney-client privileged, may constitute inside information, and is intended only for the use of the addressee.
