I explained in a previous email to Mr. Epstein that the changes made to DPNR's draft consent agreement is not only substantive, but also does not fall within the language of "SEP". I was asked and I agreed to allow for a SEP in lieu of a penalty. The language DPNR drafted is the correct language. I can tweak the language, but the language can not read like the Respondent is making a donation to settle this matter. As before I was told about a specific issue and language was worked out. I requested that Great Jim, indicate with specificity the issue to see if language can be worked out. However, the draft document that Mr. Epstein signed, I can not sign. Finally, there will continue to be delays, with every suggested language change.
