Additionally, I think we maneuvered them into stating we could ask the Commissioner to reconsider the 45 feet height restriction on the flagpole, particularly since the permit hasn't been fully executed as yet. It is clear to me the section referenced to limit the height appears to refer to attachments on a building than a freestanding pole. Hopefully the Commissioner can prevail with that.
