The U.S. Supreme Court rejected an appeal by an American citizen to have his birthplace listed in his passport as Jerusalem Israel. In doing so the court did not make a judgement as to whether Jerusalem is indeed the capital, but more narrowly determined that the Executive Branch has the sole power to recognize foreign nations. [2:2Ntlyths Facts: 2012 Although the court may have been correct in interpreting the law, it ignored the historical and practical reality that Jerusalem is Israel's capital. As the plaintiffs attorneys said after the decision was announced, the court perpetuated "the absurd position that no country is sovereign over Jerusalem, and that no part of the city, including the western portion of Jerusalem,...is in Israel."
