The trustee had a duty to distribute equally and timely. The trustee failed. The risk of loss does not fall on the beneficiary and I am sure that the trustee took the benfit of the gains as well as the use of the money. I have attached a redline of our last agreement with changes to reflect that the 426 was paid in full which we expect to occur shortly. Martin has not reviewed this revision and the client has not approved the discrepancy in the numbers that you and Martin have discussed.
