Since Ms. Noel was charged in this case and placed on administrative leave from her position with the BOP, she has applied to two employment opportunities. In the Fall of 2020, she applied for a Claims Specialist position with the Social Security Administration. She has not received an acceptance or rejection yet. In January 2021, she applied for a Contact Tracer position with an organization called Public Consulting Group. Other than acknowledging her application, she has not heard back. There is a possibility that the pending criminal charges have affected her ability to successfully land one of these two positions. If Ms. Noel receives a felony conviction, she will automatically be terminated from her current position with the BOP. Ms. Noel intends to continue building her career in law enforcement and intends on applying for positions with the United States Department of Veterans Affairs Police, U.S. Customs and Border Patrol, Transportation Security Administration ("TSA"), and private security companies. A felony conviction would legally prohibit her from obtaining any of these employment opportunities. The inability to possess a firearm would also prohibit her from these opportunities. Ms. Noel is also interested in exploring employment opportunities in the health care field. In 2013, Ms. Noel obtained a New York State Emergency Medical Technician ("EMT') certificate when she was employed as a Patient Administrative Specialist in the Army. See Tova Noel EMT Certificate, attached hereto as Exhibit A. She is interested in renewing her EMT certification and applying to become a paramedic. A felony conviction would prevent EFTA00089486 FOY & SEPLOWITZ LLC ATTORNEYS AT LAW PAGE 2 her from pursuing this opportunity and exploring other health care related opportunities that require state licenses or certifications. The collateral consequences of a felony conviction and the prohibition from exploring these opportunities would significantly limit Ms. Noel's ability to make a living to care and provide for her family.
