On Friday June 16, 2006, I met with ASA
at the State Attorne 's Office
to discuss the arrest warrant request for Jeffrey Epstien,
and
ASA
stated she had been ill during the week of June 9 and part of e wee o
June 16, 2006. According to ASA
, During that time State Attorney
met with the defense council of Jeffrey Epstein. They discussed the fact, that due
to the strict regulations in the Virgin Islands, where Epstein resides, the original charges
would classify Epstein as a sexual offender. Therefore, the State Attorney agreed to seek
a felony solicitation of prostitution char e. This new charge would not classify Epstein
as a sex offender. I explained to ASA
that I did not agree with the charge and
requested they seek the original charges requested on the warrant. ASA
presented a letter written by the defense council to State Attorney

letter stated the strict regulations for sexual offenders in the Virgin Islands and depicted

that www.mvspace.com does not verify any information which is placed
on the personal profiles. Defense council explained that based on the fact that the
personal profile, which includes a es, income and personal information, was not
accurate, and should not deem

that to be an irregular practice as I have never been asked to submit a new probable cause
affidavit. I further advised her although I was not the official representative of the police
department, I would not re-write a new probable cause affidavit for Epstein. I further
explained that the original probable cause I submitted with the arrest warrant request, was
the entire case and the information would not char e. I returned to the police
department and briefed SgtM and Capt
of what transpired.
On June 19, 2006, I made telephone contact with ASA
ASA-
provided the Florida State Statute she was told to charge Epstein. The F.S.S. 796.07 4(c)
would make the solicitation of prostitution a third degree felony. The statute read "A
felony in the third degree for a third or subsequent violation." I explained to her that I
felt this charge was designated for the repeat offender or three separate convictions of
solicitation. ASA
stated she read the statute as three separate occasions. I
explained to her that Administration was consulted and they felt the new probable cause
affidavit request was unwarranted.

ADMINISTRATIVE ORDER NO. 06 - 12.092 - 9/06*
Purpose: To promote and preserve the orderly and efficient administration of justice
while the Court case management system is unavailable as a result of the required computer
system conversion, it is necessary to establish a temporary procedure for the administration of
the court documents and court business. Beginning at 5:00 P.M. on September 29, 2006 and
continuing through 5:00 A.M. on October 10, 2006. The conversion will take place;
THEREFORE in accordance with the authority vested in the Chief Judge by Rule
2.050(b)(2), Florida Rules of Judicial Administration it is Ordered as follows:
1.
Beginning September 30, 2006 and continuing through October 9, 2006,
case initiation and document processing will be suspended until the system
entirely can "go live" on or before October 10, 2006, except as specifically
set forth herein. The Clerk and Comptroller's office shall accept and time
stamp all court documents filed during this time.
Time stamped
documents will be held and processed in the new case management system
upon completion of the conversion, according to priorities established by
the rules of court and laws of this State with consideration given to the
clock-in date.
2.
Beginning September 30, 2006 and continuing through October 9, 2006,
case initiation and judicial assignment will be suspended with the
exception of the following: Any essential filings for First Appearances
Capiases, VOP's, warrants, any petitions for repeat, date and domestic
violence injunctions, shelter and detention hearings, Baker Act cases,
emergency
temporary
guardianships,
adult
protective
services,
incapacities, Marchman Act cases, JAC cases, capital cases and other
emergency filings as defined by Administrative Order 2.004. The Clerk
and Comptroller is directed to use a historically utilized manual random
case assignment methodology.
3.
Beginning September 30, 2006 and continuing through October 9, 2006, case processing
shall be suspended with the exception of the following: Essential progressing of those cases

initiated under paragraph 2, extension of 90 day service time; civil warrants, civil writs, criminal
and civil warrants, satisfaction of judgments, reinstatement of driver's licenses; issuance of
capias, collection agreements, civil and criminal injunctions.
4.
Beginning September 30, 2006 and continuing through October 9, 2006, the Clerk and
Comptroller's office will accept and disburse monies that are due and payable pursuant to statute
ordinance, court order, or other applicable legal authority by non-eletronic methods.
5.
Other matters will be initiated, and/or processed as the Chief Judge may determine are
necessary for the orderly and efficient administration of justice including cases that are already in
the course of trial cases necessary to meet speedy trial deadlines as set by a Judge.
6.
On September 29, 2006 after 5:00 p.m. ISS shall print calendars and other reports as
requested for two weeks for all Branches of the Court and shall provide same to the Clerk and
Comptroller for distribution to the Court as needed. As well, ISS shall provide the last case
number for all case types to the Clerk.
7.
From October 2, 2006 through October 9, 2006 filings shall only be accepted at the
Central Courthouse Facility, located at 205 North Dixie Highway, West Palm Beach, Fl 33401,
unless they are labeled an "Emergency" or are a Petition for Domestic, Repeat of Dating
Violence. If accepted at the branch facility filings shall be send via facsimile to the central
courthouse facility for filing. They shall be ruled upon by the Judge assigned the case, or if
unavailable the administrative designated alternate or then the duty judge pursuant to
Administrative Order 2.004. Any pleading labeled "emergency" shall have attached thereto by
the person filing same copies of all pleadings filed after September 29th, 2006.
8.
During his time period Judges shall not hold motion calendar nor handle issues requiring
significant new court filings unless deemed absolutely necessary for the furtherance of justice.
9.
Jury trials including jury selection shall not be impacted and may occur during this
period.
10.
During this period, except as noted above, no hearings shall occur at neighborhood
justice centers, non-Courthouse facilities including traffic hearing facilities, drug court hearings
and Saturday Mental Health Court.
