o On 08/19/2019, SDNY submitted a nolle pros request to dismiss the case against Epstein to
Judge Berman. Judge Berman ordered a hearing be held on Tuesday, 08/27/2019, to discuss
the proposed request, citing the public's "informational interest in the process." Judge
Berman wanted to allow an opportunity for victims to be heard during the hearing. SDNY
has reached out to the victims' attorneys to advise them of the hearing and the opportunity
for them to be heard. FBI Victim Services Division (VSD) reached out to those.victims not
represented to advise the same. SDNY has offered to fund the travel of any of the victims •
who reside in Florida or other areas outside of NYC.

o Digital Evidence:

• A search warrant for the digital evidence seized from Epstein's property in the USVI
is expected to be sworn out sometime next week in the SDNY. The items have been
processed through the evidence control system, but they cannot be processed by
CART until the warrant is obtained.
• CART has completed processing the items seized from Epstein's residence in
Manhattan (with the exception of the devices that were encrypted) and is currently in
the piocess of making them available for the case agents to review. CART has
separated all documents, emails, and text files so they can be reviewed according to
the taint procedures setup by SDNY.
• CART is in the process of exporting all documents, emails, and text files to an external
storage so they can be imported into Relativity, a system that SDNY insists on using.
CART has advised this will be an extremely time consuming process and that will not
be completed until mid-September. SDNY has insisted the Relativity system be used
to facilitate the taint review for privileged communications and is willing to wait.
o Forfeiture:
• Discussions with SDNY are still ongoing regarding the forfeiture of Epstein's
properties. Epstein's death makes criminal forfeiture complicated and civil forfeiture
could prevent victims from pursuing compensation from Epstein's estate.

Background

Between 2005 and 2007, the West Palm Beach Police Department, and PBI Miami investigated Epstein
based on information provided by the parents of a victim who reported that Epstein had sexually abused
their daughter from 2002-2005. This investigation included, among other things, interviews with
approximately 35 victims, a search warrant executed on Epstein's Florida residence, and detailed
analysis of various phone and flight records.
•
The identified victims were underage females who attended local high schools and were recruited for the
purpose of engaging in sexual activity with Epstein. They ranged in age from approximately 14 to 17,
with the majority having been approximately 15 or 16 when they were recruited to perform sex acts for

or with Epstein. If the victims engaged provided massages, engaged in sexual activity with Epstein, or
recruited other minors, they were paid between $200 -$1,000.

Epstein maintains residences in Florida, New York, U.S Virgin Islands, and New Mexico.
•
In 2007, after meeting with attorneys representing Epstein, Alex Acosta, United States Attorney (USA)
for the Southern District of Florida (SDFL), approved a non-prosecution agreement which required
Epstein to plead guilty, in Florida State court, to soliciting prostitution, which he did in 2008. He was
sentenced to 18 months in jail, was permitted to serve his sentence in a facility where he was released
during the 'day to work, and was released from his sentence after serving approximately 13 months.

This non-prosecution agreement garnered significant media attention as former USA Alex Acosta was
confirmed as Secretary of Labor

In 2018, after publication of an article in the Miami Herald which detailed the above investigation,
SDNY received approval from the Deputy Attorney General (DAG) to pursue a case in the SDNY.

o On 07/06/2019, Epstein was arrested upon his arrival, via his personal ,jet, at Teterboro
airport in New Jersey. Simultaneous to his arrest, NYO executed a search warrant at his
residende in Manhattan, NY.
o NYO CART is working to process numerous computers, laptops, iPads, iPhones, hard drives,
thumb drives, and various pieces of loose digital media which were seized from the
residence. NYO CART is working with ERF as several of these items were locked or
encrypted.
o On 07/08/2019, Epstein pled not guilty during his initial appearance.
o On 07/15/2019, Epstein was denied bail during his detention hearing.
o On 07/25/2019, FBI and SDNY met with attorneys from Debevoise who represent Leslie
Wexner and his wife, Abigail. During an attorney proffer they advised the Wexners were not
close with Epstein and had no knowledge of bis sexual misconduct. They further advised
that they severed ties with Epstein in 2007 after discovering that Epstein had stolen hundreds
of thousands of dollars from them while managing their finances.
o On 07/29/2019, FBI and SDNY met with Epstein's attorneys, who, in very general terms,
discussed the possibility of a resolution of the case, and the possibility of the defendant's
cooperation. Defense Counsel did not make a specific proposal, and they did not indicate
what the nature of Epstein's cooperation might be, if any. It was suggested that Defense
Counsel contact SDNY if Epstein was prepared to accept responsibility for his conduct
and/or they had a specific proposal for a resolution of this case.
o On 08/12!2019, approximately 55 personnel from NYO and San Juan executed a search
warrant at Epstein's residence on Little Saint James (LSJ) Island near St. Thomas, Virgin
Islands. This 'resulted in the seizure of various documents and pictures as well as numerous

• A review of 142 FinCEN filings (SARs, CTRs, and FBARs) resulted in the identification
of 18 different financial/investment institutions with accounts associated to Epstein.

• On 07/13/2019, a certified appraisal was completed for the NY residence with the value
determined to be $86,250,000.
• A Notice of Pendency has been filed for the NY residence.
• Multiple subpoenas have been served on Epstein's LLC companies, which are based in
the Virgin Islands (results are pending).

Death Investigation (90A-NY-3151227):
o On 07/23/2019, Epstein was found unconscious in his cell with red marks on his neck. When
staff was able to revive Epstein, he couldn't recall what happened. Epstein's cellmate,
denied knowing anything and said he was just sitting on his bunk with earphones
on. Note:

(245D-NY-7786783) and is facing the death penalty. Epstein was removed from his cell and has
been medically evaluated. The Metropolitan Correctional Center (MCC) initiated an
investigation of the event.
o On 08/10/2019, at approximately 8:11AM, NYO was notified that Epstein was found
unresponsive in his jail cell at MCC in Manhattan, NY. The NYO initiated an investigation
into the suspicious death of a federal inmate. The NYO is collaborating with the BOP, DOJ
IO, and the NY State Office of the Medical Examiner (OCME).
