I sent a bank check for the $60,000.00 with the signed documents. I get my personal guaranty release within 10 days of either a short sale (supposedly coming in few days) or foreclosure sale (set for Jan.). The $60,000.00 is in trust and cannot be cashed until I get my personal release and dismissal of the lawsuit with prejudice. I keep my stock, and the 1099 goes to Hardman Development, so 1 can get the capital loss for taxes. I also can force Mike to give me all documents related to Hardman Development. As soon as the PNC suit is dismissed I will amend my personal lawsuit against Mike Hardman to allege fraud. Trent and my CPA say this helps with IRS and prevents the debt from being dischargeable if Mike files for bankruptcy. I spoke with the officer at Regions Bank about the $200,000.00 line of credit I owe (this is of the $550,000.00 I am suing Mike for). It is supposed to go to the "workout dept." Haven't heard but I keep e-mailing the officer so I have a paper trail. I hope to talk with them before the PNC dismissal because this may help me get a lower payoff. If not, I'll pay the $200,00.00 and be done with the debts caused by Mike. Then it is time to start rebuilding (or with this economy, trying to protect what I have left from erosion!). Can't worry about water over a dead horse, eh?
