Re:
Its=got other peoples stuff on it as well. So here is stuff related to L=J and GSJ - I am writing to follow up:
Has Mr. Epstein confirmed what dates he would like us to conduct our site v=sit and has he granted us permission to
have access to his property?
I hope you are enjoying the holidays.
I was made aware of =nauthorized section 10 and 404 activities that are occurring on the island=, as well as concerns for
resources. Terry Wells <=font>and I would like to conduct a site visit.
Very respectfully,
Jonathan Pempek
Biologist- USACE
=br>
(Terry Wel=s is the enforcement person for our district.)
Can you provide a date that yo= can accommodate our inspection in the last two weeks in January, and seco=dly do you
have correspondence or a contract with the property owner that =uggest their willingness to provide us with site
access? If so, can you se=d me this document so that I can check this off of my list? I would like t= begin making
arrangements for this trip as soon as possible.
Very respectfully,
Jonathan Pempek"
I=have not provided any response, he is scheduling a number of site visits, =pparently they have been reviewing the
aerials flown since the hurricanes.=C2 Some of the sites are docks and structure with no permits at all. =AO We could
probably get away with just driving them around the islands on=the boat. We could tell them you have guests.
Section 10 would primarily be structures and 404 are issue= that effect water quality. They have jurisdiction over
marin= structures anything off shore and wetlands. They could be concerned=about some clearing around saltponds or
changes to docks. I don'= think you have anything to worry about on the docks they haven't chan=ed. They may not
necessarily be aware of all the issues with the GSJ=dock and may just be noting its not permitted when this is an issue
which =re-dates your ownership and is something we are working on. I have t=ied to minimize any conversations with
them, but I can push and find out w=at their issues are if you would like me to.

Nothing will be happening until mid next week. = did get an email yesterday late from the COE gentlemen who
want to visit.=C2 Apparently they have some reports (pictures) of things they want to =heck out on both islands. Well
do best to walk them through eve=ything. Its hard to make judgement calls off the aerials and probabl= most if not all
of what they are looking at should not be a problem or so=ething very minor. I plan to use their visit to push the new
docks.=C2 We can show them how shallow it is in Shallow Bay and why we want to=move.
