Please be advised that it has been brought to our at=ention that there is still activity happening on Great
St. James. Dn.-January 30, 2019, we received a report from Enforcement stating that they =aw machinery moving stuff
around on the shore on the Christmas Cove side of the island. Enforcement also spo=ted what looked to be a barge
delivering a dump truck to the island. As we=discussed in our meeting, the C&D is still in place until we have reso=ved
the questions of the permits, and repair work is required to be reported to the Department. One purpose of these
po=icies is to ensure that any work is being done in a way that would have mi=imal adverse effects on the environment.
As Pedro mentioned in our meeting= no Best Management Practices were put in place for any of the activities done on
the island. 40=A0 The exclusion of BMP's can result in additional citations= Please note that marine impact may
constitute a federal offense if =ny protected Endangered Species Act species are observed in the impacted area. Amy
Dempsey could provide further information on this topic.<=>
We trust that you will notify your client of what we=discussed so that he can avoid any further issues
with the department.Q=A0 I will notify you of what I find regarding the permit issue.<=u>
Warm Regards,
