This preliminary inquiry is, according to the rules contained in Article 11 of the French code of criminal procedure, covered by secrecy, in the sense that only the investigators and prosecutor's office have access to witness interviews in EFTA00084091 relation to the investigation. Violating this secrecy is punishable by up to one year in prison. Attorneys, witnesses, and victims that are part of the investigation do not hove access to the file. However, as you have no doubt already inferred, the media interest created by this matter is such that a variety of information has been distributed, against our wishes. We are there not in position to guarantee total confidentiality in relation to information provided officially as part of the investigation. Nevertheless, we thought that an informal exchange would be desirable, in a restricted setting, with our counterparts in New York. This method would, by contrast, lend itself to guarantee full confidentiality of our communications and would be useful to help orient the French investigation. In terms of confidentiality, they explained that information we share would stay confidential. This would be the case until a criminal defendant is placed under examination, at which point that person would have access to the investigative file; but they are not at that stage yet. She added that the press could not have access to the investigative file at this time. I am waiting on a written follow up from them on this point. They are preparing to execute search warrants, possible as early as next week, and don't want to interfere with the US case.
