During the investigation, DVR systems, which stored recorded video of cameras within the New York Metropolitan Correctional Center (MCC), were seized from MCC. After the video was extracted, the video was uploaded by a unit within FBIHQ OTD to a system within OPWAN, called UK. The video could only be reviewed, not downloaded, by the case team. There were no missing minutes during this original upload. DOJ OIG requested a copy of the video due to DOJ OIG not having access to the FBI software. The download had to be requested through OTD and the video was put on a hard drive and given to DOJ OIG, and SDNY, in approximately late 2019 or early 2020. FBI New York handed over this copy of the video to aid in DOJ OIG's investigation. FBI New York did not request this copy back nor did DOJ OIG return the copy. EFTA00163761 FBI New York closed its investigation in May 2022. The two defendants who were charged in November 2019 had entered into a deferred prosecution agreement with the Southern District of New York (SDNY) and by May 2022, that agreement had been satisfied. At this time, the DOJ OIG was still conducting its investigation. With concurrence from the SDNY AUSA and FBI New York C19 SSA, all evidence, to include CART derivative evidence, was transferred to DOJ OIG, as the evidence was still pertinent to DOJ OIG's investigation. DOJ OIG released its findings to Congress in June 2023. After this release to Congress, DOJ OIG officially closed its investigation. Following the closure of its investigation, DOJ OIG returned evidence to FBI New York. Currently all Epstein evidence is presently located at WFO evidence control per HQ request earlier this year. The prepping and formatting for this recent video release was conducted by OTD. NYO will defer to OTD on the inner workings of the process and they will provide that information under separate cover. At the risk of oversimplifying things it is my understanding that through the years, enhancement techniques and reformatting processes to make the video viewable on the several different platforms the FBI has used the past 5 years have most likely caused these small gaps of missing minutes. However the one system where we can still see a continuous video with no gaps is the USAfx system (explained more below). Again, I will defer to OTD for their expertise in this realm. It is important to note, FBI New York was unaware the video in question was being turned over to DOJ for further public release. It was not until the news ran on the missing minutes that NYO became aware this video was released to the public. As such, NYO was not afforded an opportunity to quality control the video, which would have included a request to OTD to strip all metadata from the video prior to release. This metadata was the basis for the recent scrutiny highlighted in the articles from Wired. Additionally, NYO relied on the expertise of OTD to provide why the missing minutes exist and did not provide any additional input. Recently, after news ran of the missing minutes, conversations between the FBI New York case agent and DOJ OIG case agent revealed the video currently resides on a shared drive within the DOJ OIG from their original request in 2019/2020. It is unknown by the DOJ OIG case agent if this derivative hard drive still exists, and if it does, who is in possession of the hard drive. According to the DOJ OIG case agent, hard drives are frequently erased after a case is closed and then reused for a pending investigation. As a result, the DOJ OIG case agent uploaded the video to a folder within USAFx. The FBI New York case agent was able to download the video from this USAFx folder, which showed no missing minutes on the night Epstein committed suicide.
