I was just set for trial, so the earliest I will be able to reschedule the testimony will be after Thanksgiving. I will give you a call to discuss the immunity issue but I am concerned about other things we have talked about -- if Ms. Miller is given immunity, will she be forthcoming and answer the questions? Or am I going to jump through hoops to get her immunity and then have to worry about filing motions to compel, motions for orders to show cause why she shouldn't be held in contempt, etc., etc.? As always, thank you for your assistance. Regards, Marie A. Marie Villafafia Assistant U.S. Attorney 561 209-1047 Fax 561 8204777 [email protected] From: [email protected] [mailto:[email protected]] Sent: Tuesday, October 24, 2006 12:00 PM To: Villafana, Ann Marie C. (USAFLS) Subject: Re: Tatum Miller Sorry I did not get back to you sooner. I have been out of town for several weeks. As to Miss Miller, she still does not wish to testify in this case and has a Fifth Amendment basis for her position. She wishes not to accept the "proffer letter " cover of immunity, which again is her right. I think it is a waste of time to have her appear Friday to just take the Fifth. I suggest that you huddle with your people. (It is football season). If you want to push the issue you will have to get formal immunity. I will accept service now and in the future for you so you don't have to chase Tatum down. Jim Eisenberg 2 EFTA00223699 Villafana, Ann Marie C. (USAFLS) From: Villafana, Ann Marie C. And/or would you like me to apply for permission to include someone from one of the northern counties? On another note, we had talked about doing a PSC road show to meet with state and local law enforcement agencies. How does your schedule look for November 28th through the 30th? Diana (USAF LS) Read: 1115/2006 10:18 AM Hi Bob, Corey, and Diana -- There is going to be a national Project Safe Childhood Conference in Washington, DC, during the week of December 3rd. We have received tentative approval to pay the expenses of a local/state law enforcement officer to attend, and I was hoping that you could recommend someone that you work with regularly to attend. A number of courses are being offered on topics like forensics, the spread of child pornography, and the psychology of the child predator, so it should be pretty interesting and it would be a nice "thank you" for someone who has worked hard in this area. We are at the top of the waiting list for a spot, so they are going to tell me today if we get the spot and I have to tell them today who is going to fill the spot, so if you could get back to me this morning, it would be most appreciated. I will need to provide contact info and an e-mail address for whomever is going to attend. I am happy to call to extend the invite, or if you would rather call directly, the conference starts the morning of December 4th and ends at noon on December 6th, so travel will be the afternoon of December 3rd returning the afternoon of December 6th. One of them is Basic Criminal Law, which includes basic federal procedure, client relations, and ethics, starring the following illustrious faculty -- David Marcus, Bill Barzee, Joaquin Mendes, and Brian Tannebaum. Dear Mr. Starr:

Dear Mr. Starr: I write in response to your November 2811' letter, in which you raise concerns regarding the Non-Prosecution Agreement between this Office and your client, Mr. Epstein. I take these concerns seriously. As your letter focused on the Section 2255 portion of the Agreement, my response will focus primarily to that issues as well. The reporter is a former detective. He told the FBI agent that his sources tell him "the State has been bought off," and asked if our investigation had been sent to "the circular file." Nesbitt responded, "All I can tell you is that we have an open investigation." On another note, I am going to see the grand jury tomorrow and I anticipate a number of questions regarding the status of the indictment. I'm not sure what, if anything, I can tell them. And I did not hear back regarding making changes to the indictment. Can I get some feedback on that? Thank you. A. Marie Villafana Assistant U.S. Attorney 500 S.
