ST-10-CV-443 ) Plaintiffs, ) ) v. ) ACTION FOR DAMAGES ) FANCELLI PANELING, INC., ) ) Defendant. ) ORDER The Court held a scheduling conference in this matter on August 1, 2011.' At that time, the Court considered the parties' proposed scheduling plan, which was filed on August 1, 2011. By Order dated June 2, 2011, the Court had directed the parties to file their scheduling plan by July 25, 2011. The Court takes the opportunity to remind counsel that its orders are not voluntary; failures to abide by them could lead to sanctions. At the time of the conference, the parties expressed some concern regarding the difficulty of formulating a plan for discovery while not knowing the outcome of the pending motions for reconsideration. However, the Court desires to put into place discovery deadlines to govern the management of this matter. Should the decisions regarding the motions for reconsideration require an adjustment of these deadlines, the parties may make an appropriate motion. Therefore, the Court will require the parties to abide by the discovery deadlines set forth below. The Court will also issue a separate mediation order. Accordingly, it is hereby ORDERED that the parties shall abide by the following discovery deadlines, which shall not be modified except for good cause and by prior leave of Court: • The parties shall exchange Rule 26(a)(1) disclosures on or before October 15, 2011; • The parties shall complete all written discovery on or before November 1, 2011; The parties shall complete mediation on or before December 1, 2011; The parties shall complete non-expert depositions on or before January 15, 2012; • Plaintiffs shall submit to Defendant their retained expert reports on or before March 15, 2012, and Defendant shall submit to Plaintiffs its retained expert reports on or before I Denise Francois, Esq., of Hodge & Francois, appeared on behalf of Plaintiffs Jeffrey Epstein and L.S.J.
