Dear Assistant Attorney General Goldman:
I received your letter dated March 2, 2015 requesting that J. Epstein Virgin
Islands Foundation, Inc. (the "Foundation") file a Form CHAR 410 and Schedule E
thereto in order for the Charities Bureau to confirm the Foundation's exemption
from registration under the provisions of the Estate Powers & Trust Law and Article
7-A of the Executive Law. As stated in my letter to you dated February 10, 2015, the
Foundation has never solicited charitable contributions, nor engaged in any other
charitable activities, in the State of New York and, for that reason, we respectfully
disagree with the assertion that the Charities Bureau has any authority to require
the Foundation to register. Nevertheless, the Foundation wishes to fully cooperate
with your inquiry and encloses a completed Form CHAR 410 and attachments
thereto, along with Schedule E, for the limited purpose of enabling the Charities
Bureau to confirm the Foundation's exempt status. The Foundation does so,
however, without prejudice to its right to contest your jurisdiction over the
Foundation.
