Re: Mr. Jeffrey Epstein
Dear Sergeant Herzberg:
Thank you for taking the time yesterday to discuss Mr. Epstein's reporting obligations in
light of his recent assessment in New York as a Level 3 Offender. I wanted to confirm
your advice that, although New York has given notice to Mr. Epstein of his being
assessed as a Level 3 Offender, SOMU continues to consider Mr. Epstein an out of state
offender who is not living in New York, and that Mr. Epstein should ensure that he
complies with the registration obligations of the jurisdiction of his permanent
residence. I also wanted to confirm your advice that, although Mr. Epstein has a
vacation home in New York City that he visits temporarily for periods of less than 10
days at a time, unless Mr. Epstein changes his address to New York (i.e., by staying in
New York for 10 days or more), SOMU does not consider SORA's 90 day reporting
requirement for Level 3 Offenders as being applicable to Mr. Epstein as an out of state
offender, and does not require that Mr. Epstein personally report to SOMU to verify his
registration information.
Additionally, I write to confirm your advice that Mr. Epstein need not continue to inform
your office of his temporary visits to his New York vacation home, unless Mr. Epstein
intends to remain in New York for 10 days or more, which would trigger his
requirement to report his change of address to New York. I want to assure you that Mr.
Epstein will continue to fully comply with all of the registration and reporting
requirements of the jurisdiction of his permanent residence and the other jurisdictions
in which Mr. Epstein has an address and has registered as a sex offender, including New
York State.
