Dear Mr. Goldberger: I spoke today to Mrs. Arlene Swan, the Interstate Compact Administrator for the Virgin Islands, following delivery to her of my letter detailing the terms of the one year of enhanced probation, i.e., "community control", to which Mr. Epstein will be subject under the terms of his sentence. I had asked her, as suggested by the Correction Services Administrator in Florida, that she provide us with a letter, stating that in principle her agency would accept Mr. Epstein's transfer with the accompanying enhanced restrictions, assuming of course that he met all the other requirements. She promptly called me and indicated that she was supportive of requests for Virgin Islands residents to return home under the Compact, with supervision to be provided here, but in her view, it was not procedurally correct for her to first send a letter stating that the Virgin Islands would accept this transfer, before receiving directly from Florida authorities, a request for transfer under the Interstate Compact. She did indicate that she would very promptly provide her response on receipt from Florida of the standard application. It was my clear understanding that she is prepared to consent to this request, provided the proper formalities are followed. Under the circumstances, I would suggest that Mr. Lane be informed of Ms. Swan's position, and asked to proceed to initiate the standard application. I will then follow up with Ms. Swan to insure that anything further required to complete the process is done. Let me know if there is anything further I can do to assist.
