Richard Kahn HBRK Associates Inc. 575 Lexington Avenue, 4th Floor New York, NY 10022 Begin forwarded message: From: Lawrence Krauss Date: February 11, 2015 at 12:37:49 AM To: Richard Kahn Cc: Lawrence Krauss Subject: a slight amendment of the gift letter, if possible. Dear Rich: I hope he New Year is going well. Thanks for coordinating the gift to Origins so quickly in Dec. I just found out that, if possible, the ASU foundation, which manages gifts, would like some minor changes in the gift letter. Moving through this process for the second time you're aware that all contributed funds are received through the ASU Foundation for A New American University. Further, all philanthropic gifts in support of Arizona State University and its programs operate within a specific set of guidelines, which are documented in the attached Gift Acceptance Terms and Conditions. These also are posted on the ASU Foundation's website: www.asufoundation.org/giftagreements. Usually, the foundation drafts these agreements, and they include prototype language that makes the attached Terms and Conditions document an indelible "Attachment A"; They do so to avoid future misunderstanding and to remain as transparent as possible. The ASU Foundation is comfortable using your letter of intent as basis for documenting this generous investment in the Origins Project, and my development officer has updated the original document you provided with this prototype language and also provide space for the Foundation's two approved countersigners. The main change is to the first paragraph on page 2. Also, some language in the initial paragraph acknowledges the first payment in 2014, and the entire doc has been re-dated to 2015. All highlighted in yellow. EFTA00642829 If it is not too much of a pain, I am wondering if you are ok with this and can send a new letter. Sony for the hassle.
