The information being provided is confidential and is for settlement purposes only. We expect that you agree and will advise your client that this information shall not be used for any purpose other than for the review by your firm, your client, and your experts in consideration of fees and costs owed to us by Mr. Epstein. In response to your December 111h correspondence re "Special Master Agreement", the common or general designation was for work that applied to all cases. Amy and Susie identified specific clients when work was done on behalf of specific clients rather than done for all clients. Susie used case numbers, which we redacted from what was provided to you previously, and Amy used clients' initials, which we also redacted from what was provided to you previously. We will provide you the case numbers and/or clients' initials attributable for the work done by each of them on behalf of specific clients. We have enclosed the case numbers assigned for each of our clients. In reviewing the billings provided to you, we noticed that in some cases the billings allocated to certain files appear to be skewed when compared with others. We are reviewing what might account for this skewing, e.g., the inadvertent mis-attribution of time and expenses where case numbers and/or clients' initials were similar or simple transcription errors. Nevertheless, we assure you that, while the allocations may in some instances appear to be off, the bottom line of the amount of time and expenses was done meticulously and the total dollar figure is accurate. • Port Lauderdale svww.pcKlhurst.com EFTA00723455 We separated expenses related to photocopying, depositions, and experts' examinations and reports, etc. other than Amy and Susie's since neither of them charged anything for their photocopying, printing, and other miscellaneous expenses. Those from our regular office services should be easily differentiated in the records provided. The persons/entities who examined our clients appear as costs on our billings. They are Dr. Deborah Day and Dr. Kathleen McHugh of Psychological Affiliates, Inc. Their curriculum vitae and bills are enclosed. We will eventually allow your experts and the Special Master to review ow psychological experts' final reports and bills with names redacted or coded. Resumes and/or curriculum vitae for Amy, Susie, Evelyn Sheehan, and Jimmy Doddo will be provided. Legal assistants' names and those of law clerks are at the end of each billing statement. There was no timekeeper who charged a fee. The hourly billing rates of each lawyer, law clerk, and legal assistant in our office who works on a file in any given period are also set forth at the end of our billing statements. Amy and Susie's bills were prepared as they are accustomed to doing, and not on our fum's standard time sheets. Theirs are far more precise and meticulous than ours. The NPA states that we will charge our customary rates. We have done so. The hourly rates were agreed to at the time of my appointment and are not an issue. To answer your inquiries in your December 16th letter re "Epstein Matter", we will submit to you our additional bills through November 30°. The $526,466.15 paid by Mr. Epstein to date is a credit against the total amount of $2,012,160.15 billed thus far, which leaves, as of October 3r, an outstanding balance of $1,485,694.00. Enclosed is a page from our lime sheets. The code classifications that are typically used can be seen at the cop right. In response to your December le correspondence re "Epstein Matter-Fee Issue", the Special Master Agreement's language was finalized with all of your requested revisions and provided to you and your client for execution more than six weeks ago. Despite our repeated requests for your signatures, we received no signatures or responses until your correspondences last week, which seem to indicate that we do not have an agreement. If this is your position, as surprising and disappointing as it is to us, we will proceed accordingly. Additionally, after Sidney Stubbs' resignation, we repeatedly requested additional proposed names of Special Masters from you. You said you would do so. You have not provided any to date. You never asked me for nominees until your December 181" letter. We are again providing you with the eight names we suggested at our June 1'7i° meeting. Those names were/are: Ned Davis, Tom Scott, Jerry Wetherington, Jerry Kogan, Phil Hubbert, Herb Klein, Herb Stetton, and Jim Chaplain. We are also proposing Tam Wilson. EFTA00723456 Finally, we are again requesting that you provide available dates for this hearing. We have a distinct feeling that we have been taken advantage of for months. We gave you dates for a hearing back in October and hoped that you would do it on December 16th. We are no closer to a hearing date now than we were months ago. You wrote that you will be "starting to focus" on finalizing the Special Master Agreement after the first of the year. We were led to believe by you months ago that it was finalized, but instead have been stonewalled by you. You also wrote that you should have some nominees' names after the beginning of 2010. Why is it taking so many months for a signed agreement for a Special Master, a hearing date, and for names of nominees? The end result is that our payments, and Mr. Epstein's fulfillment of his responsibilities, are being delayed for an unacceptable amount of time.
