Dear Ms. Swan:
My client, Jeffrey Epstein, is and has been a full-time resident of the Virgin
Islands for over 10 years. His business, Financial Trust Company, Inc., located at Red
Hook Quarter, has been an outstanding and active member of the Virgin Islands
community. Through his business and his residence on Little St. James, Mr. Epstein has
employed, on average, over 60 people per year. On June 30, 2008, Mr. Epstein agreed to
plead guilty in a Florida state court to two non-violent felony counts relating to
prostitution. He received an 18-month Palm Beach County sentence to be followed by
one year of supervision. As per the residence requirement of the Interstate Compact, Mr.
Epstein has resided in the Virgin Islands the entire year before his sentence. As both his
legal residence and place of employment are the Virgin Islands, I write to request your
assistance in the expedited transfer of Mr. Epstein's supervision from the State of Florida
to the Virgin Islands.
In connection with his plea, Mr. Epstein also agreed to one year of enhanced
probation, i.e., "community control", following his incarceration. As you are probably
aware, under the unique law of the State of Florida, a "community control" sentence is an
enhanced form of probation, where the offender in addition to his normal weekday
supervision he may also be subject to supervision on weekends and holidays. As an
additional condition to ordinary probation, Mr. Epstein is also required to meet with his
probation officer at least once a week, as opposed to once a month, and has agreed to be
subject to a list of additional restrictions. Please see the attached for the list of additional
restrictions. As you will note, Mr. Epstein is required, at least under Florida law, to
register as a sex offender. His state charge was a non-violent sex offense, i.e. procuring a
minor for prostitution. We recognize that Virgin Islands law would govern as to Mr.
Epstein's registration requirements.
As the Interstate Compact Administrator, we request that you in principle
approve Mr. Epstein's transfer of supervision. We have been in contact with Mr. Lane,
the Interstate Compact coordinator for the State of Florida, who has suggested that the
most appropriate way to move this process forward would be for us to first receive an
acknowlegment from your office, that the Virgin Islands would accept a transfer with
enhanced restrictions, assuming everything else was standard. He would then forward on
to you the standard application to begin the transfer process. Mr. Lane also
acknowledged that there is precedent for such a transfer. and has suggested this
procedure to most easily effectuate the transfer. We can provide you with a filled out
sample of the transfer documents if you would find it helpful.
As previously mentioned, the Virgin Islands is Mr. Epstein's home. Since Mr.
Epstein set down his roots here over 10 years ago, he has generously donated his time
and financial resources for local scholarships, educational and social programs and other
worthy philanthropic endeavors. Mr. Epstein and his business, Financial Trust Company,
Inc., currently employ more than 50 people in the Virgin Islands. The company strongly
encourages employees to participate in professional and personal development programs

at the company's expense and provides tuition assistance to foster the educational
development of the family members of its employees. Mr. Epstein, himself, frequently
provides aid and support to his employees in times of financial emergency or personal
crisis. Substantial pressing demands of Mr. Epstein's Virgin Islands based business and
the continued financial wellbeing of its employees, as well as Mr. Epstein's other
employees, make it imperative that Mr. Epstein resume work on St. Thomas as soon as
possible.
Mr. Epstein's supervision is to begin on July 22, 2009. We hope to initiate the
transfer process as soon as possible in order to ensure that there is sufficient time for the
transfer to take place in the ordinary course. Accordingly, we respectfully request your
assistance with a confirmatory letter at your earliest convenience.
