On December 23, 2008 I asked for backup to the Jan 2, 2007 payment of $178,000. I never received it. We paid $178,000 only upon your verbal instructions but no back up ever followed. Your records show that Alan had gone to Europe the first week in December , and had a kidney stone surgery the second week. You have all the emails from him during that period, and they are few. I have received three pages of illegible writing that relates to October (one entry on 11/17. I can't read 2 other entries), January thru March. ( I assume that these illegible writings refer to October 2006 and January thru March 2007) and nothing else. I would like to see may of 06, details.. I have reviewed and re-reviewed the numbers. He has billed for hours outside of Cambridge , but has shown no backup. ( Does out of town billings include only time worked or does it include the entire out-of-town time spent including eating, sleeping and other recreation, even Lewis Tein's crazy bills had a max of 8 hours out of town , for a 24 hour period, does Alan's meetings in New York„ I have no backup to tie out his numbers?? ) I need details of out of state hours billed. As far as the $100,000 paid to Alan Dershowitz's brother— my records show that we have properly accounted for that payment. You paid a total of 3,935,613 to Alan Dershowitz . This comprised of 3,335,151 paid to Alan Dershowitz and 600,462 paid to other attorneys by Alan Dershowitz. Included in the 600,462 an amount of 427,438 was paid to Dershowitz Eiger which included the 100,000 payment that Alan Dershowitz is questioning. I am confused as to why this issue has to come-up again. I have re checked at your request and find we have not received any invoices at all for services performed during 2009. His email says 23 hours until April, but that is the only record. You have definitely overpaid him, in gross terms, now withstanding the fact that every other person, except Marty Weinberg discounted their bills between 15-20% due to the horrible results.
