Jeffrey asked you not to over promise on delivery right from the start. You ask that we delay input until middle May with a guarantee of aug 1 delivery. Jeffrey said it is now unlikely due to carpet delays for no reason. I need to tell him to charter a long range plane for his middle east trip . this is not his fault. t am very disappointed that his plane took a back seat to 5015. Rich said he asked when you first looked at the cabin door and the plane sat for over one month with no numbers. still today! What would you like me to tell Jeffrey? will the carpet and plane be ready or not?" In my effort to address your question and selective interpretation of the facts and accounts that have led us to this point in your refurbishment. I feel an obligation to remind you of just a few of the numerous points that provide a far more accurate and well-rounded account than what you have described, which has led us to the point that we are at today. At IJI we always work on more than one aircraft at a time and your aircraft did NOT take a back seat to sn 5015 as you noted. We accepted your aircraft based upon an identified work scope and a reasonable and customary time frame to select materials and identify all required details of the work scope. Further, I find it presumptuous for Jeffrey (and at times Rich) to "presume" how long it should take to create / modify / refurbish an aircraft interior furnishing when they have no first-hand experience in this discipline / craft. This project started out as a complete modification and refurbishment, inclusive of all soft goods, woodwork, metal plating, floor plan change and heavy modifications. Much design work and time was spent in preparation for this size project including numerous interior layout and cabinetry drawings, procurement of numerous material samples(especially those related to the seating to match an Hermes cashmere blanket / 2006 Bentley Arnage), matching of wood logs to the Hermes tray table, paint renderings, etc. Lastly, please make note that the intended work scope that was identified and verbally agreed to for this "phase" in the refurbishment was clearly articulated in my e-mail to Jeffrey and Rich Kahn in my e-mail dated May 11th when I wrote: "Attached is our revised proposal which reflects the limited work scope - "Phase l"." EFTA00802436 On May 7'" Jeffrey wrote to me: "the plan i think is as follows give you the plane 19 th for only soft goods carpet and lower side panel bathroom sink and counter top remove glasses tray. pick up plane July 30 . give you bk , for soft goods.nov 15, give you 550 for wood and electronics. till feb fly bk in the interim. will you have a foam mock up ready for tues moming ? or is that too early." Schedule- on May tir and 91" I wrote to Jeffrey: Seats, divans, carpet, lower side panels, etc... no problem at all during the proposed time frame of May 19th -July 30th." "assume"that you will select all materials fairly quickly?' "Breaking up the refurbishment limits certain work - especially as it relates to modifications (galley area / possibly lay vanity). We can however accomplish: • Carpet • Lower side panels • Cabin single seats • Divans • Fwd and aft lavatory potty seats • Crew Seats" No Numbers- Fully itemized costs have been identified for the intended work scope since May 111". Additional items have / continue to be requested and although I have requested a signed agreement and had started working with Darren Indyke on his preference of verbiage, still no formally executed document. When presented the ordinary course of contractual events (executed proposal, deposit, change order...), I have been repeatedly informed that Jeffrey wants ALL of the items listed into one agreement before signing. Yesterday I received an e-mail from Jeffrey regarding yet another completely new request (iPhone docking station) that he will expect pricing for: "Tables - leather insert and iPhone dock instead of cup holder" Bottom line is that the work scope request(s) are fluidly continuous, which unless a line in the sand is drawn, create a self-fulfilling cycle of chicken or egg whereby a written contract appears not to be reviewed and executed (certainly delayed) due to ever evolving ideas and requests. Carpet — we have discussed numerous colors / construction / fibers for floor covering with Jeffrey, starting back on April 3rd (six weeks before the aircraft arrived). We provided three (3) dark, deep blue carpet samples for Jeffrey to review back on April 21"' (over three weeks before the aircraft's refurbishment input). On April 27," I informed Jeffrey that the type of carpet he was considering (100% wool, semi- custom machine made) will take six (6) weeks to produce. On May 19"' I received two (2) Sacco carpet samples from Karyna. When I asked Jeffrey "are the carpets for color, pattern or both", his e-mail reply was: "color". One June 10th I wrote to Jeffrey: "We sent carpet to you. Additionally, after our last conversation about achieving a luxurious look, we asked our vendor to create a sample with some artisan silk which we hope to have by wednesday. This new carpet will take 5 or so weeks to manufacture- so we are getting very close to delivery point if you elect this carpet." On June 16", I wrote: "Jeffrey, EFTA00802437 We are not way behind on the carpet for no reason. We have presented custom samples in record time- better than anyone in the industry. We were using the same wool yarn that we used in your GIV that you liked and was considering. You presented some synthetic house carpet that we matched and considered in your opinion to be a lousy quality (when it is certainly not). We have been on the phone with various mills, drilling down to people who are providing a level of detail in carpet fabrication in our attempt to satisfy you. Lastly, when asked for your participation in trying to satisfy you, you simply comment ridiculous. If you want the sheen of the sacco carpet. we need to introduce silk- which you know is very expensive and normally takes 12 weeks to construct after approval of yarn. Eileen is working diligently on your behalf to make you happy, spending numerous hours on the phone talking to various mills. I respectfully ask that you call and speak with Eileen so that we can keep things moving forward." On June 21t1 I wrote: "Jeffrey, While going through the various gyrations regarding the carpet, our mill that produced the carpet in your GIV was working exhaustively to see if they could produce a carpet to simulate the SAACO silk carpet. They are producing two (2) samples: We will have photos of both carpets this Friday the 26th and physical receipt on Wednesday the 28th. have leveraged my relationship with the mill to the absolute maximum and if we find the actual sample acceptable, they expect to be able to produce the carpet in time for your August 1 delivery." The photo of the two (2) samples were received today and the actual samples are expected at my office tomorrow — 1 day ahead of schedule, which we will then call Jeffrey to find out what address to send them to via overnight delivery. 1F" Jeffrey approves the carpet on Wednesday, I believe we can still have the aircraft ready for him for August 1s, — inclusive of many (likely not all) of the additional items he has requested as part of his refurbishment. Should Jeffrey reject the carpet on Wednesday and not elect an alternative carpet (100% wool same as the GIV — which he was considering) then the schedule will be held up until a carpet selection has been identified.
