Dear Judge Smith.
Please be advised that the undersigned represents Mr. Jeffrey Epstein, with regard to the
defense in the above referenced matter.
We have been provided with a copy of a letter sent to you on March 29, 2018 by the
attorney for the Plaintiffs, Joe Titone. It is unfortunate that Mr. Titone appears to be
attempting, again, to ex parte the court. Because of this ex parte communication we must
respond by way of this letter.
The letter states that you were being provided with a Motion for Ruling on Service of
Process on Defendant Jeffrey Epstein with attached exhibits, filed with the clerk of March
29, 2018. In fact, the motion that is attached to the letter was Plaintiffs' Motion for Special
Set Hearing/Status Conference.
We have strenuously objected to Plaintiffs' Motion for Ruling on Service of Process which
may have been filed on March 29, 2018 and was filed on March 16, 2017. In response to
the March 16, 2017 Motion, we filed a Response to Motion for Ruling on Service of
Process on Defendant, Epstein, a Motion to Dismiss and a Memorandum in opposition to
Motion for Ruling on Service of Process. These pleadings are attached for the court's
ready reference. The situation has not changed in the past year and Mr. Epstein stands
by his pleadings regarding the lack of service of process in this matter.

Mr. Titone's letter states that he wishes to discuss the possibility of a settlement and/or
mediation. It is incomprehensible that the court could order mediation when there has
never been proper service on Mr. Epstein and the court has no jurisdiction over him.
Additionally, this entire matter was dismissed in January, 2017 by operation of this court's
Order dated October 5, 2016.
