From: Richard Kahn To: Jeffrey Epstein <[email protected]> Subject: Max Date: Mon, 18 Jun 2018 22:15:52 +0000 max reply in encyrpted message: Rich — I now have the information for 2017 and 2018 (to date) and it's attached to this email. Two items to keep in mind: 1. The information was provided to me by Bainco, in a format that's a bit different from the 2010-2016 reports, which we generated here. As a result the report is a bit "cut and paste", but I can prepare a cleaner version in due course. As you will also see, the report is in quarterly blocs, with each block showing separate figures for the Exempt and the Non-Exempt trusts. 2. Historically, our fees have been charged against Principal and Income on a 50/50 basis, which is the default for most trust administration. But as the legal fees have mounted I am (starting in 2018) exercising my discretion to charge legal fees against Principal and Income on an 80/20 basis, so that the fees will not have such a severe impact on the net income distributable to Noam. I will continue to follow that practice going forward. Thanks, Max A. I am on the west coast and will be back in the office on Monday. This morning I received notice of the filing of the Petition by Harry's attorney and Harry also copied me on his message to Noam, forwarding a copy of the pleadings to him. I assume you have seen the Petition and the supporting materials and that you understand that the Petition is limited to an action seeking the court's guidance as to the method by which my successor is to be chosen. As I am with family and an ill friend I'd be grateful if you would reply to me by email, rather than call. But if you want to set up a phone call I will try to call you at a time that's convenient for both of us. Max A.
