Wanted to make sure you are able to read what I send. I marked all of my changes in bold. I. See first paragraph indicating that the Releases are executed pursuant to the Settlement Agreement. 2. In all of the releases I added the word "rights" to the matters being released. 3. I clarified that the releases by Max and Harry in B and C are their respective releases in an individual capacity, as trustee and for and on behalf of the Trust. 4. In the release from the children in included among the released parties the Trust and Harry and Max as Trustee. I did not want a claim against Noam or Valeria for contribution or indemnification to arise out of a suit subsequently filed by the kids against the Trust or the Trustees. I also, make a specific reference in the release to claims under the Arizona financial exploitation of elders statute to which I believe you were referring during our telephone call. 5. Since the word "releasor" was not defined in Paragraph F, for further clarification I changed the reference to read: "Each signatory hereto and each releasor hereunder" I also included the work acknowledges in the rest of that clause "represents, warrants, acknowledges and agrees as follows: " 6. I added a sub paragraph 6 to paragraph F to make it abundantly clear that Noam has executed estate docs and implemented a state plan that provides for Valeria receiving everything and that the releases from the children are applicable to the estate does, the estate plan and any asserted claim of misconduct by Valeria with respect to the same. 7.
