COMMITTEE ON HOMELAND SECURITY, JUSTICE AND PUBLIC SAFETY BILL NO. 30-0109 Thirtieth Legislature of the Virgin Islands May 15, 2013 An Act amending title 14, chapter 24, section 503 of the Virgin Islands Code by adding definitions of sexual conduct and sexual contact and by amending title 14, chapter 85, section 1699 by adding a definition of sexual conduct and amending the definition of sexual contact PROPOSED BY: Senator Sammuel Sanes 1 Be it enacted by the Legislature of the Virgin Islands: 2 SECTION 1. Title 14, chapter 24, section 503 of the Virgin Islands Code is amended by adding 3 subsections (i) and (j) to read: 4 "(i) `sexual conduct' means actual or simulated: 5 (I) sexual intercourse, including genital—genital, oral-genital, anal-genital, or oral-anal, 6 whether between persons of the same or opposite sex; 7 (2) penetration of the vagina or rectum by any object except when done as part of a 8 recognized medical procedure; and 9 (3) sexual bestiality. EFTA01088001 -2- 1 Q) 'sexual contact' means any touching of another person with the genitals or any touching of 2 the genitals or anus of another person, groin, inner thighs, buttocks or the breasts of another person, or 3 such touching through the clothing, for the purpose of arousing or gratifying sexual desire of any 4 person." 5 SECTION 2. Title 14, chapter 85, section 1699 of the Virgin Islands Code is amended as 6 follows:0 7 (I) By deleting the existing subsection (c) and adding new subsections (c) and (d) to read: 8 "(c) 'sexual conduct' means actual or simulated: 9 (I) Sexual intercourse, including genital to genital, oral to genital, anal to genital, or oral- 10 anal, whether between persons of the same or opposite sex. 11 (2) Penetration of the vagina or rectum by any object when done as part of a recognized 12 medical procedure. 13 (3) Sexual bestiality, sexual relations between a person and any animal. 14 (d) 'sexual contact' means any touching of another person with the genitals or any touching 15 of the genitals, anus, groin, inner thighs, buttocks or breasts of another person, or such touching 16 through the clothing, for the purpose of arousing or gratifying sexual desire of any person." 17 (2) By re-lettering the existing subsections accordingly. 18 19 BILL SUMMARY 20 This bill amends title 14, chapter 24, section 503 of the Virgin Islands Code by adding 21 definitions of sexual conduct and sexual contact and by amending title 14, chapter 85, section 1699 by 22 adding a definition of sexual conduct and amending the definition of sexual contact. 23 24 BR13-0288/March 25, 2013/LHM /Reviewed by MMH EFTA01088002
