King Airport Terminal Building 2n° Floor St. Thomas, U.S. Virgin Islands 00802 Telephone: FAX June 22, 2011 Ms. Maria Tankenson Hodge Hodge & Francois Attorneys At Law 1340 Taarnberg St. Thomas, VI 00802 RE: Request for Modification of Major CZM Permit No. CZT- 05-99(W) L.S.J., LLC (Little St. James) St. Thomas, Virgin Islands Dear Ms. Hodge: On June 16, 2011, the St. Thomas Committee of the VI CZM Commission met to act on your request to modify CZM Major Permit No. CZT-05-99(W). The proposed modification is limited to the following: a). Installation of two (2) mooring buoys with double screw anchor with chains held off the bottom with a large float primarily used when seas are too rough for the vessels to sit at the dock. b). Addition of a covered structure with an area approximately 560 ft.2 at the end of the existing dock to provide arriving and departing passengers with a shaded area to wait. c). Addition of a covered structure on the adjacent land with an area of approximately 200 ie, near the dock with similar construction, to provide an additional area for passengers to await a vessel calling at the dock. The proposed development is located on Little St. James Island. EFTA01091531 LSJ, LLC (Little St. James) CZT-05-99(W) Request for Modification It was determined that the proposed modification does not change the nature, scope or characteristics of your approved Major CZM Permit No. CZT-05-99(W). Therefore, your request for the modification as described above, is hereby approved with the following conditions: a. The Permittee shall notify the Division of Coastal Zone Management (CZM) two (2) working days prior to commencement of work. b. Building Permits shall be obtained prior to commencement of work. c. Turbidity barriers and other mitigative measures shall be implemented to prevent any degradation of coastal water quality. d. No other work is allowed. e. The moorings shall be used for temporary, periodic use only. No overnight use is allowed. f. The Permittee shall negotiate the increase in submerged land fees with the Division of Coastal Zone Management for the new structures occupying submerged land.
