ORDER ON MOTION FOR RECONSIDERATION
THIS CAUSE having come before the Court upon BRADLEY J. EDWARD's
Motion for Reconsideration predicated upon the most recent opinion from the Fourth
District Court of Appeal in Alvarez v. Cooper Tire & Rubber Co. (citation omitted) in regard
to this Court's Order sustaining Plaintiff's Objections to Discovery Requests. Based upon
the foregoing, it is
CONSIDERED, ORDERED AND ADJUDGED as follows:
Initially, this Court would note that the decision in Alvarez is still on
Rehearing and, therefore, it is not a final opinion. Nevertheless, based upon argument of
counsel, BRADLEY J. EDWARD's Motion for Reconsideration is denied except as to
Interrogatory No. 1 and Interrogatory No. 7 and the Plaintiff shall respond to said
discovery within ten (10) days of this Order. The Court finds that the Objections as to the
discoverability of the questions and documents (i.e., relevant or calculated to lead to
admissible evidence and/or overbroad) are sustained in the form currently submitted
under the pleadings as currently filed.
