DRAFT Alicia V .Barnes, Commissioner Designee Department of Planning and Natural Resources Via Hand Delivery Re: Request for Modification to Coastal Zone Management (CZM) Permit No. CZT-5-99W, Little St. James Island, LLC Dear Commissioner Barnes: By this letter and the attached documents, which are incorporated herein by reference, Little St. James, LLC (LSJ) applies for modification of the referenced CZM Permit No. CZT-5-99W. As this request does not involve any new activity in the water, we understand that there is no requirement that we submit this request as a Joint Application for an Army Corps of Engineers permit. The scope of this application for modification is limited to: Addition of a covered structure at the end of the existing dock to provide arriving and departing passengers with a shaded area to wait, Addition of a covered structure on the adjacent land, near the dock, with similar construction, to provide an additional area for passengers to await a vessel calling at the dock. Also, in accord with your advice by letter of February 3, 2011, in response to our previously filed application for a new minor permit to allow the installation of two moorings adjacent to the dock, that your staff had found that request should be processed as a modification to the existing CZM Permit No. CZT-5-99, we ask that the activity involving installation of the two moorings, as described in that application, be authorized under this modification request. We believe that the proposed modification will not substantially alter the scope, nature or characteristics of the existing, approved and permitted development. As you will see from the drawings and photo of a similar structure on the island, the proposed additions are very modest in scope and fully in accord with the existing structures in appearance. Accordingly, we respectfully request that you, pursuant to your authority under 12 V.I.R.R. § 910-14, exercise your discretion, determine that the modification will not substantially alter the scope, nature or characteristics of the existing, approved and permitted development and forward your written determination to the St. Thomas Committee of the Virgin Islands Coastal Zone Commission with your request that the Committee determine and impose such conditions on the modified permit as it deems appropriate. EFTA01153172 In support of this application for modification of CZM Permit No. CZT-5-99W, LSJ submits an Environmental Assessment Report prepared by its consultant Bioimpact, Inc, fully describing the proposed moorings, and an EAR prepared by regarding the two structures on and adjacent to the dock.
