New York Observer January 27, 2003 SECTION: MEDIA & SOCIETY; Crime Blotter, Pg. 2 LENGTH: 925 words HEADLINE: Crime Blotter BYLINE: Ralph Gardner Jr. BODY: Socialite's Investigation Revealslt Was the Butler -- and the Maid If you're a wealthy socialite, there's nothing quite like having a hard- working, presentable maid or butler in service. Well, actually there is: having both a hard-working, competent maid and a butler in service. Even better is if they're happily married to one another; the household is bound to positively buzz with harmony. Unless, of course, the reason they're so compatible is that they share an interest in thievery, as was allegedly the case with the servants recently dismissed by -- or, to be more accurate, arrested on Jan. 9 at the behest of -- Ghislaine Maxwell, Manhattan socialite about town, daughter of the deceased British media baron Robert Maxwell, and occasional dinner companion of former President Bill Clinton. In recent weeks, Ms. Maxwell apparently noticed that some of her belongings were vanishing from her East 65th Street townhouse. "She started to realize stuff was missing," explained a detective familiar with the case. He added that the homeowner undertook an investigation, which led her to the basement apartment in her building where her maid and butler lived. Her search revealed some familiar items. "She found her Christmas gifts there," the detective stated, "and $7,600 [that had been] missing from her safe." A law-enforcement source said that some of the gifts were actually discovered in the oven. Barbara Thompson, a spokeswoman for the Manhattan District Attorney's office, said that in addition to the cash, $10,000 in clothing and jewelry were also taken. According to the NYPD, when Ms. Maxwell ventured into her staff's cellar abode, she allegedly found more than just her money and her stocking stuffers. She told the police that she saw what the cops described as "an undetermined amount of credit cards and what appeared to be fraudulent drivers' licenses and license plates." On Jan. 9, the suspects -- Victor Sagucio, 34, and Marabini Sagucio, 36 EFTA01594327 -- were arrested pursuant to a search warrant and charged with criminal possession of stolen property and grand larceny. Neither had prior arrest records and were released without bail. However, the investigation continues as Ms. Maxwell remembers other items that are missing. Kiddie Porn Kids are growing up faster and faster these days. Even so, the two young men browsing the porno racks around 6 p.m. at a newsstand at 1585 Second Avenue on Jan. 6 were really pushing the envelope. The perps, described by a store employee as 8 and 10 years old respectively, were none too happy when asked to leave the premises. They complied -- but approximately five minutes after their departure, a chunk of ice came crashing through the front window. The newsstand worker reported that he then saw the juveniles flee northbound on Second Avenue. Besides having captured them on videotape, the employee was able to provide some descriptive details on the mischief- makers: The older one was dressed in a black coat, the younger suspect sported a brown coat, and both were wearing school backpacks. Tools Make the Man If the poor workman blames his tools, then the talented one should praise his, as a team of burglars who stole $100,000 worth of Rolex watches from a Madison Avenue jewelry store on Jan. 3 would undoubtedly attest. The exact time of the incident is unknown. The burglars unscrewed the window frame and seamlessly removed the pane by attaching suction cups to it. The glass out of the way, they helped themselves to the pricey watches and fled on foot. Two male suspects were spotted fleeing northbound on Madison Avenue, while a female accomplice left the scene and headed across 74th Street. The police canvassed the area, with negative results. Return Policy Barneys, despite the changes it has gone through over the years, remains known for its discerning, high-end and -- if one may be so bold -- well- mannered clientele. If any pushing and shoving goes on, it's most likely at the makeup counter, among fashionistas eager to test-run the latest beauty products. Therefore, it undoubtedly came as something of a surprise -- certainly more so than it would at a rival department store such as Bloomingdale's, whose ambiance better lends itself to the hoi polloi -- when two gentlemen visited the store after closing hours on Jan. 5 and tried to break down the door. They'd apparently come not to shop for post-holiday bargains in the men's department, but to even the score with a female security guard who had been instrumental in arresting a friend of theirs, a former Barneys employee. Their friend, a 42-year-old female, had been arrested at the store on Jan. 3 EFTA01594328 and charged with grand larceny. One of the enforcers, described as 6-foot-1 and 220 pounds, with a muscular build and wearing a black bomber jacket, allegedly stated, "Where is the security guard?", and "You're going to see what happens," and "Shut the fuck up." The security guard he was addressing (not, apparently, the one the two thugs were looking for) was standing on the other side of the locked door, refusing them entry. The second perp -- also a male, described as skinny, 5- foot-6 and 150 pounds, with a scruffy beard and long brown hair -- apparently said nothing worth quoting. In any case, when the two saw they weren't getting anywhere, they retreated to the corner of 61st Street and Madison Avenue, where they stood for about 15 minutes before departing without further incident. The Mirror March 31, 2001, Saturday SECTION: NEWS; Pg. 4 LENGTH: 305 words HEADLINE: MAXWELL SCANDAL: THE REPORT - FAMILY: WIDOW'S MODEST LIFE BODY: MAXWELL's widow Betty now prefers to be known as Dr Elisabeth Maxwell and has become a leader in the Jewish community. The 80-year-old lives in a modest flat in Pimlico, south London. After initially defending her husband's memory, Mrs Maxwell now acknowledges his faults but says he was corrupted by power. Kevin Maxwell, 42, has enjoyed mixed fortunes since the demise of his father's empire in 1991. He was declared Britain's biggest bankrupt in 1992, with pounds 406million worth of debt. Sanctions were lifted in 1996 and Kevin continued his well-paid if not always successful business career. In ten years, he has been a director of 81 different firms of which only 32 have survived. Two years ago he teamed up with his elder brother Ian to head a telecoms group Telemonde. While the firm's suppliers have struggled for payments, Kevin pockets pounds 240,000 a year. Ian Maxwell took over Mirror Group after his father's death but had to resign when the pensions scandal broke. Together with brother Kevin in 1996, he was cleared of fraud charges related to Robert Maxwell's business dealings. But the 44-year-old endured the break-up of his marriage to TV producer Laura Plumb. He is a director of 31 companies, four of which face insolvency. Ghislaine Maxwell moved to New York after the scandal engulfed her family. The 39-year-old is a close friend of Prince Andrew and often holidays with the royal. She has also been linked to billionaire Manhattan property developer EFTA01594330 Jeffrey Epstein. Twins Christine and Isabel cashed in on the internet boom, starting a software company in California. They pocketed pounds 100million thanks to a programme that helps people surf the web. Both are married and live on America's west coast. Christine also has a home in France. GRAPHIC: TOGETHER: Robert Maxwell with his family LOAD-DATE: March 31, 2001 EFTA01594331 Copyright 2001 Associated Newspapers Ltd. DAILY MAIL (London) January 6, 2001 SECTION: Pg. 11 LENGTH: 1076 words HEADLINE: 12 days that shook Buckingham Palace BYLINE: Richard Kay;Geoffrey Levy BODY: THEY haven't quite ruined the festive season but it's been close. One after another, news of their exasperating behaviour has thudded on to the nation's breakfast tables. Princess Anne behaving boorishly towards an elderly lady handing her a flower decoration. Prince Andrew cavorting endlessly and aimlessly in the sunshine of the Far East. And even Princess Margaret, ill as she is, evoking the unsympathetic observation that she is a victim of a royally excessive lifestyle. All this week at Buckingham Palace, while the family's principal figures have been away at Sandringham on their annual New Year break, senior courtiers have been becoming more and more concerned. Every day seems to have brought a new piece of unwelcome news about what certain other members of the family are up to. Little of it brings good cheer. Mostly, they know, it has provoked anger among the public. To the people whose lives are committed to the welfare of the monarchy, this has been one of the worst periods of public disapproval since the death of Princess Diana. No, it is not a crisis. Not quite. Or as one senior official muttered with distinct discomfort yesterday: 'Not yet.' The constant stream of uncomfortable news reopened the debate at the Palace this week about the future direction of the monarchy. The question is about the size of the official Royal Family and who should formally feature as its members. Prince Charles has believed for some time that a 'downsized' slimmer Royal Family is a more secure and successful EFTA01594332 Royal Family. He feels that any behaviour that attracts criticism weakens the monarchy. Some at the Palace already believe that the monarchy should consist only of the sovereign, his or her heir, and the heir's children. Were this arrangement to be in position now, this would automatically displace the Princess Royal, Prince Andrew and Princess Margaret from their centre-stage positions and banish them to the wings. This would leave a front-rank Royal Family consisting of the Queen and Prince Philip, Prince Charles, and his sons William and Harry. Putting Princess Margaret on one side for the moment and she is perhaps unfortunate to have been drawn into this period of royal misfortune this would be a crushing blow for both Andrew and his sister Anne. For both have shown unbelievably bad timing to display the less attractive side of their characters to the world. Anne tersely murmured, when Iris Halfpenny gave her a flower basket outside the Sandringham church on Christmas Day, that it was 'a ridiculous thing to do'. She is expected to take on considerably more official duties in the coming years to help out her mother, now 74, and more importantly her father, who will be 80 in June. As for Andrew, flabby at 40, he leaves the Navy after 21 years in April and faces a future which would be completely blank but for his roistering without an official job being found for him. One has been, of course he is taking over from the Duke of Kent as vice- chairman of British Trade International, a hugely important roving ambassadorial role drumming up trade for Britain. As one senior Palace courtier complains: 'He hasn't looked much like an ambassador this week, has he?' Andrew has taken over, again from his cousin the Duke of Kent, as president of the Football Association and is anticipating a much wider role as a front-rank royal, carrying out important public engagements. This week Andrew has been pictured cavorting with topless beauties on a rich man's boat anchored off Phuket, in Thailand. If the shots of him having cream smeared into his sun- scorched body by a topless friend had been of his ex-wife Fergie, they would have raised an outcry from Buckingham Palace. EFTA01594333 They follow pictures of him looking rather dishevelled at a Halloween 'hookers and pimps' fancy dress party in New York, and emerging in the early hours from London nightclubs. Obviously, there is no reason why a man of 40 who is no longer married, should not enjoy himself in the company of pretty girls. But Andrew has been making too much of a habit of partying, lately, from London to New York, and not always in the company you would expect to find the Queen's favourite son. His most constant friend appears to be New York-based Ghislaine Maxwell, 39, daughter of the monstrous fraud Robert Maxwell. He named his private yacht from which he died after her and stole employees' pension savings to service his own investments. Miss Maxwell can hardly be held responsible for the actions of her dead father, nor should she be. And yet, is there not something troubling about a Maxwell daughter, who never seems to be short of money, becoming the social fulcrum of the Duke of York's life, introducing him to a kaleidoscope of her socialite friends whenever they are together? At the Palace, they are certainly a trifle uneasy about it. Princess Anne, 50, is experienced enough to have kept her tongue between her teeth or at least, as her friends would expect, in her cheek in taking an old lady's gift, rather than allowing her explosive side to surface, upsetting so many people. No wonder they are worried at the Palace. No wonder they talk of new arrangements and fearfully wonder what is coming next for the blast of censure has been fierce at a time of the year when the Royal Family can normally expect to bask in public approval. Anne has done her best to claw back the situation with what she saw as an amusing remark 'You are taking a big risk, you know' she said to people offering her flowers a week later though, being Anne, she never actually apologised. Last night she resumed her formal royal duties, presenting the British Nautical Awards at the London Hilton Hotel in Park Lane. She would have dazzled, she would have smiled. It would have helped to disperse the criticism that followed her thoughtless outburst. Some of the old ladies who said they would never turn out for the Royal EFTA01594334 Family again may yet change their minds. Andrew was returning from his latest holiday today. The tragedy is that he cannot understand why he is the object of criticism. But at Buckingham Palace, they know why. These are different, less deferential times. They know that people do not overlook the misdemeanours or excesses of members of the Royal Family as readily as they used to. GRAPHIC: ABOVE LEFT: A TERSE ANNE ON CHRISTMAS DAY. The New York Post December 1, 2000, Friday SECTION: All Editions; Pg. 009 LENGTH: 316 words HEADLINE: SOCIETY GIRL AT TWITS' END BYLINE: Neal Travis BODY: THINGS may be turning sour for gal-about-town Ghislaine Maxwell, daughter of the fat and fraudulent former owner of the Daily News, the late Robert Maxwell. I hear that some of the 39-year-old Ghislaine's friends on the Manhattan and London party circuit are cutting her because she's had so much adverse press over her relationship with Prince Andrew, Fergie's ex, with whom she recently attended a downtown S&M-themed party. Her relationship with "Randy Andy" is said to be platonic, but the socially prominent women in Ghislaine's "set" have recently sworn off any kind of publicity. A series of lacerating articles - and the publication of the vapid "Bright Young Things," written by one of their own, Brooke de Ocampo - has portrayed this crowd as a bunch of twits living off their trust funds. Ghislaine's own funds are something of a mystery. Her father lavished money on her and set her up in at least one business in New York. But Maxwell's own ill-gotten gains were seized after he took a dive off his yacht, which was named for her. There are plenty of British pensioners who lost their only means of support in the crash of Maxwell's house of cards and who find it obscene that Ghislaine manages to own an apartment on the Upper East Side and a mews house in London. She is said to be on some kind of retainer from mysterious New York financier Jeffrey Epstein, who reportedly has holdings in several major companies. Epstein also likes the company of attractive young women, and it's said that Ghislaine has been very good about introducing him to some of her pals. Ghislaine and her two elder sisters don't talk about where their money is coming from, but they are said to be heavily involved in some kind of Internet company. It would be awful luck for Ghislaine if her social standing were diminished at the same time as tech stocks are going down the toilet. LOAD-DATE: December 1, 2000 EFTA01594336 Copyright 1997 Agence France Presse Agence France Presse February 18, 1997 18:19 GMT SECTION: International news LENGTH: 334 words HEADLINE: Robert Maxwell's daughter says he was murdered DATELINE: LONDON, Feb 18 BODY: Ghislaine Maxwell, daughter of late media tycoon Robert Maxwell, said Tuesday she was convinced he had been murdered in her first media interview since her father's mysterious death at sea in 1991. "One thing I am sure about is that he did not commit suicide. That was just not consistent with his character. I think he was murdered," Maxwell's daughter said in an interview with the mass circulation magazine Hello! In November 1991, Maxwell's body was found near his yacht Lady Ghislaine off the coast of the Canary Islands. An inquest concluded that Maxwell was the victim of accidental death, a verdict contested by his wife. "He did not commit suicide because he didn't drown. There is no evidence of suicide," said his 35-year-old daughter who lives in New York. "There is no evidence that he had a heart attack," she continued. "I can't see my father going to the side of a boat and slipping off the side. It is not easy to fall off the side of a boat." "It was not unhelpful to certain parties that the suicide theory was put about, because it meant his life insurance policy would be in dispute," Ghislaine Maxwell argued. She said she had not previously given any interviews because she did not want to add to already voluminous press coverage during the trials of her brothers Ian and Kevin Maxwell, who were acquitted in January last year of charges of fraudulent misuse of pension funds to save the crumbling family empire. pbl/bl/bm AFP EFTA01594337 LOAD-DATE: February 18, 1997 EFTA01594338 Copyright 1996 The Press Association Limited Press Association August 9, 1996, Friday SECTION: HOME NEWS LENGTH: 491 words HEADLINE: MAXWELL'S DRINK-DRIVE DAUGHTER GAVE POLICE TEA BODY: Robert Maxwell's daughter treated tired traffic police to tea and biscuits and a flick through the family photographs at her brother's home after she was arrested her for drink-driving, a court was told today. But Ghislaine Maxwell's middle-of-the-night hospitality could not save her from a L1,000 fine and a year's driving ban at London's Horseferry Road Court. Miss Maxwell, 34, whose tycoon father named his private yacht after her, earlier joked with police that she had not had a drink for more than four years and was allergic to it - although she was well over the limit at the time, the court heard. She had taken the arresting officers to her brother Ian's home in Elvaston Mews, South Kensington, to prove that although she had no fixed address in England, she had somewhere to stay. Nazir Afzal, prosecuting, said: "It is fair to say that Miss Maxwell is one of the most co-operative customers that Chelsea police station hve had. "She took them to her brother's home, made them a cup of tea, showed them some family photographs and promised to write to their senior officer to commend them for their hospitality." The officers left satisfied that she had a sound address to stay at, said Mr Afzal. Paris-born Miss Maxwell was described on the chargesheet as an Internet operator of no fixed address in the UK, although her lawyer said she as a business consultant. She admitted driving a blue E-registration Volkswagen Golf GT1 with excess alcohol. Mr Afzal said she was stopped in Harrington Road, South Kensington, at 4.30am because the car had no headlights on. "She said that she was sorry, and at this point police noticed the smell of intoxicating liquor on her breath," said Mr Afzal. "When asked when she had her last alcoholic drink, she replied: 'About two minutes ago'." She failed a roadside breath test and was arrested. Further tests at the police station show she had an alcohol content of 55 microgrammes, which Mr Afzal said was about one-and-a-half times the legal limit. When cautioned, Miss Maxwell allegedly said: "I am allergic to alcohol. I haven't had a drink for four-and-a-half years." Mr Afzal added: "The officers didn't take any notice of that and she then apologised." Keith Oliver, defending, said: "She had attended a dinner party but in the event, had little to eatand on an empty stomach, drank two or three glasses of wine." He described Miss Maxwell as a woman "of moderate means", based in New York, where she had been resident for five years. Mr Oliver added that Miss Maxwell had returned to America after being bailed by police and flew back to Britain especially for the hearing. Magistrate Anthony Eadie also ordered her to pay L75 costs. Miss Maxwell, smartly EFTA01594339 dressed in a black mini-skirt and matching top, with her hair tied back, refused to comment after the hearing. Ghislaine Maxwell issued the order on Nov. 8, the Daily Mirror reported Wednesday. "Ghislaine rushed through the yacht's lounges and cabins and rifled drawers and cabinets, plucking documents from them indiscriminately and throwing them to the ground," wrote senior reporter John Jackson, who said he witnessed the incident. "She shouted to the crew, I order you to shred immediately everything I have thrown on the floor!"' The Daily Mirror, as the flagship of the Mirror Group newspapers, has broken several stories on the fall of the Maxwell empire and has gone so far as to accuse Maxwell of being a thief. The newspaper said Ghislaine Maxwell, in New York, "totally and utterly" denies the allegations. In another announcement Wednesday, Britain's Serious Fraud Office said it is investigating allegations of stock manipulation. According to the allegations, shares in Maxwell Communication Corp. PLC were illegally sold to prop up the price of the stock. The stock had been pledged as loan collateral. Maxwell allegedly siphoned off more than $1.2 billion from public and private Maxwell companies and their pension funds to hold together his disintegrating media empire, which includes the Daily News in New York. EFTA01594341 He allegedly used the pension funds to service debts, cover operating losses, gamble in the foreign exchange markets, and support the stock of his publicly held companies. Maxwell died on Nov. 5 off the Canary Islands in the Atlantic. His nude body was found in the water hours after he disappeared from his yacht. An autopsy report said he probably died of a heart attack. It did not reach a final determination, however, and some insurance investigators reportedly think the mogul committed suicide. The Serious Fraud Office has been investigating missing pension funds of Maxwell's Mirror Group Newspapers PLC, as well as missing funds from the Mirror Group. The agency is also looking into a complaint from Swiss Bank Corp., which says it did not receive collateral for a $100 million loan to a small private Maxwell company. Asked why he didn't report this earlier, Jackson replied: "It didn't really come to mind until reports came over the weekend that faxes had gone missing." Mr George Staple will not seek renewal of his contract when it expires in 1997. Yesterday, he said he had always planned to step down at the end of his contract despite the outcome of the Maxwell case. Mr Kevin Maxwell, 36, son of the late media baron Robert Maxwell, was acquitted on Friday - along with his brother Ian, 39, and former company director Larry Trachtenberg - after a trial lasting 131 days. It was alleged the trio had fraudulently used L122m of pensioners' money. The trial is estimated to have cost more than L20m. Mr Staple, 55, yesterday told BBC Radio 4: "I was appointed in April 1992 for five years and it has always been my intention not to seek a renewal of my contract after April 1997. "It is not linked to any particular case and particularly not to the Maxwell case." There were calls for the SFO to be scrapped in the wake of the acquittals but the office has received the backing of the Government's chief law officer, Attorney General Sir Nicholas Lyell. The SFO will announce in court on Friday whether it intends to proceed with further charges on the Maxwell indictments. The roles of both the SFO and jury in major fraud trials are in question in the aftermath of the Maxwell trial. Former chairman of the Bar Council, Mr Anthony Scrivener, said he believed the days of the Serious Fraud Office were numbered. "The SFO, by the very nature of their office, make cases long," Mr EFTA01594344 Scrivener said. "They don't shorten cases and whenever they get their hands on a case it becomes of inordinate length." Sir Nicholas defended the SFO, saying it would have to be invented if it did not exist. However, he said the Government was considering replacing juries with a judge and a panel of experts. United Press International May 31, 1995, Wednesday, BC cycle SECTION: International LENGTH: 656 words HEADLINE: Maxwell fraud trial opens in London BYLINE: BY SHARMILA DEVI DATELINE: LONDON, May 31 BODY: The sons of the late media tycoon Robert Maxwell, Kevin and Ian, and two other top executives from the Maxwell business empire went on trial Wednesday on criminal fraud charges for alleged misuse of the companies' pension funds. The four defendants have denied the charges of defrauding Maxwell pensioners after the mysterious death of Robert Maxwell in November 1991. They are alleged to have misused shares belonging to the pension funds as collateral for bank overdrafts to help prop up the Maxwell companies. On trial alongside the Maxwell brothers are Larry Trachtenberg, who was a director of various Maxwell companies, and Robert Bunn, former finance director of the main public company in the Maxwell empire. Maxwell's businesses collapsed and were found to be heavily in debt after he disappeared from his yacht Lady Ghislaine on Nov. 21, 1991. His publishing companies included the Mirror Group whose flagship the Daily Mirror is Britain's second-largest circulation daily. The chief prosecutor acting for the Serious Fraud Office opened the trial at a computer-equipped London courtroom by taking great care to explain financial jargon to the jury. The judge has ruled that the jury of seven women and five men will only sit for four hours each morning to allow them to digest the complex evidence concerning Maxwell's business dealings. Afternoons will be used for legal arguments out of the presense of the jury. The trial is expected to last six months. The prosecution accused Kevin Maxwell of being the most responsible out of the four defendants for the misuse of pension fund assets. He alone faces a charge of conspiracy with his late father in dealings in 5.4 million shares worth 100 million pounds ($160 million) in a Israeli publishing equipment company, Scitex Corporation Ltd., earlier in 1991. They are alleged to have used the shares, which were pension fund assets, to obtain bank loans for the ailing Maxwell companies. All four defendants face one count of conspiracy to defraud, involving shares worth 22 million pounds ($35.2 million) in Teva Pharmaceuticals, an Israeli drug company, also in 1991. Justice Nicholas Phillips warned the jury as the trial started that they should disregard the sensational publicity surrounding the EFTA01594346 case before the Maxwell brothers were charged. He said much of the media coverage was "objectionable and unfair" and he told the jury to be on guard against prejudice and bias. He also warned journalists of legal restrictions that limit reporting of the case essentially to details that are raised in evidence. Journalists can be held in contempt of court for reporting background details, out-of- court interviews or other information that may prejudice the chances of a fair trial. The restrictions lead to trial coverage that is far removed from the U.S. experience of celebrity trials like the current 0.J. Simpson case. Domestic interest in the Maxwells was highlighted by the 50-meter (yard) line of photographers and cameramen waiting outside the courtroom to get shots of the defendants as they arrived Wednesday morning. No cameras are allowed in British courtrooms. The trial is expected to be one of the most expensive ever to reach a British court, and British taxpayers could face a bill as high as 25 million pounds ($40 million). The defendants have been granted legal aid for their defense, which is costing an estimated 4.7 million pounds ($7. 52 million). The teams of top lawyers wearing traditional robes and wigs contrasted with the modern courtroom equipped with computer technology that is rarely used in British courts. Computer screens around the room allow lawyers to see virtually simultaneous transcripts of evidence given by up to 60 witnessses and the thousands of documents being used in the case. The system costs a reported 1,800 pounds ($1,600) a day. LOAD-DATE: June 1, 1995 EFTA01594347 Copyright 1992 CanWest Interactive, a division of CanWest Global Communications Corp. Ian Maxwell, 36, and Kevin, 33 appeared in a London court. They were released after posting a combined bail in excess of $1 million. Larry Trachtenberg, a former director of the company that handled the Maxwell empire's pension funds, was also charged. Both Trachtenberg and Kevin Maxwell face several additional charges of theft, said John Todd, detective superintendent with the City of London Police. A total of 15 charges have been laid. Officials from Britain's Serious Fraud Office have been trying for months to track millions of dollars missing from several Maxwell companies and a fund meant to support 32,000 Maxwell company pensioners, many of whom face destitution as a result of the missing money. The media baron was found dead last November after he went missing from his yacht off the Canary Islands. Maxwell's empire -- thought to be intact when he died -- stretched across the Atlantic and included both the Mirror Group of newspapers in Britain and the New York Daily News. Maxwell's sons have been the focus of attention since last December, when the empire collapsed under the weight of more than two billion pounds of debt. EFTA01594348 The Serious Fraud Office has been investigating more than 450 million pounds missing from the pension fund, a further 100 million pounds missing from the Mirror Group and a loan of 55 million pounds to the Swiss Bank Corporation, which first called in British investigators. One charge against Kevin Maxwell is that he conspired, along with Trachtenberg, to defraud the Swiss Bank Corp. of more than five million pounds. He and Trachtenberg are also charged with five other counts of theft for a grand total of 43 million pounds, news reports said today, adding all three men are charged with conspiracy to defraud the Swiss Volksbank of more than $35 million U.S. The charges, good news to groups representing the pensioners, also worried some of them. While the British government has pledged 2.5 million pounds toward filling the empty pension coffers, there is little prospect of much more money coming their way. "We don't want to be told by the government that because this is now under litigation, our claim for compensation is going to be put off," one pensioner told the BBC. MCC was worth L788.4 million and shares traded at 121p before dealing was suspended when Robert Maxwell was reported missing at sea off Tenerife from his yacht, Lady Ghislaine. But in the two weeks since the publisher's death, and as Spanish authorities continue their investigation into its cause, the share price has plummeted and the company is now worth about L235 million. The shares closed at a new low of 36p as fears grew about the group's debt crisis. The Maxwell family businesses and MCC are closely linked. It is thought that the family has pledged a large part of its 68% stake in MCC as collateral to cover the family business debts. Mirror Group Newspapers shares went up 1p to close at 127p on speculation that the Maxwell family could be forced to sell it off. In Spain, authorities probing the 68-year- old tycoon's death had hoped the results of tests on his body at Madrid's National Institute of Toxicology would be complete by the end of this week. But according to Dr Carlos Lopez de Lamela, the pathologist who carried out the initial post mortem examination, they are unlikely to be finished until next Wednesday. Latest reports from Tenerife have focused on a tiny mark under Mr Maxwell's left ear, which is said to have resembled a perforation caused by a syringe. "Preliminary indications are that there was no criminal activity involved in this. There seemed to be no signs of violence. At first glance, it looks like natural causes," Canary Islands chief prosecutor Juan Guerra Manrique told reporters after attending the autopsy. Guerra would not answer questions, but earlier he told state-run Spanish Television that the 68-year-old tabloid tycoon's death could have been caused "by something like a heart attack." Maxwell vanished from his yacht off the Canary Islands sometime Tuesday morning. Full autopsy results are not expected for about a week because samples have to be sent to the Spanish mainland. Spanish national radio said earlier that Maxwell's body was found unclothed and showed no signs of violence. Earlier today, the publisher's widow, Elizabeth Maxwell, spent an hour with a judge in a courtroom outside Las Palmas, giving him information on her husband's activities, including the kind of medication he used, British Vice-Consul Campbell Livingstone said. Livingstone said Maxwell expected to remain in the islands until she was able to leave with her husband's body. He said the judge hoped to turn the body over to local undertakers after receiving the preliminary autopsy report today. Maxwell's Mirror Group Newspapers said the 55-metre Lady Ghislaine was EFTA01594352 under way when Maxwell was last seen, walking on its deck before dawn Tuesday. The newspaper group said in a statement that he had been the vessel's only passenger, in addition to about a dozen crew members. Weather reports said the skies were clear and seas calm. The Mirror of London, Maxwell's flagship newspaper, said Maxwell had dined alone on Tenerife Monday night then reboarded the yacht and instructed his crew to cruise all night at sea. The boards of Maxwell's companies named Maxwell's son Kevin, 32, as acting chairman of Maxwell Communications, and son Ian, 35, as acting chairman of the Mirror Group. The sons have long worked in the family business. Maxwell's mysterious death comes as the $2 billion (U.S.) global publishing empire he personally ran, which includes the struggling New York News, is burdened with debt. Maxwell had been selling assets to raise money to meet a $750 million payment due in October 1992. In addition, Maxwell had political troubles. He was suing U.S. journalist Seymour Hersh for alleging in a new book that he had ties to Israel's Mossad spy agency. In London, Charles Wilson, director of the Mirror Group, said there had been no suggestion of foul play in the death: "We can only assume that Mr. Maxwell slipped and fell overboard." Wilson also ruled out suicide, saying: "He had too much of the arrogance of his own ability to conceive of such a thing." Maxwell was a big man with a powerful basso voice who browbeat his editors, fought a titanic running battle with rival publisher Rupert Murdoch, and jetted about the world visiting presidents and prime ministers. "My primary duty is to hire and fire editors," he said recently. Born Labji Hoch to Jewish peasants in Czechoslovakia, Maxwell lost his parents in the Nazi Holocaust and escaped to Britain in 1940. He was a highly decorated Second World War veteran. "He was larger than life," British Conservative party legislator Anthony Beaumont-Dark said of Maxwell. "He was the Citizen Kane of his time." His death raised questions about the future of his holdings. In addition to the New York News, which he rescued from the brink of collapse in March, Maxwell owns several British tabloids and the European, an English-language weekly he founded in May 1990. EFTA01594353 This year, Maxwell sold 49 per cent of the Mirror Group of newspapers in a public offering and his Pergamon Press publishing house to a Dutch company. He also sold part of his U.S. publishing house, Macmillan, to a British publisher. Maxwell's oldest son, Phillip, flew to the Canary Islands with Maxwell's widow, Elizabeth, to identify the body. The yacht's captain, Gus Rankin, said Maxwell wanted "to cruise all night out at sea" so they decided to head in the direction of Grand Canary island. Maxwell was reported last seen by a member of the crew at 4:25 a.m. Tuesday, walking the deck of the Lady Ghislaine. His last message was a call to the bridge 20 minutes later, asking that the air-conditioning be turned down The $21-milliion yacht turned back to Tenerife, anchoring eight kilometres off its southern coast at 9:30 a.m. Ninety minutes later, a phone call to Maxwell's state room was not answered, prompting a search. Three Spanish helicopters, a plane and three ships searched for six hours and found the body floating in the Atlantic between Grand Canary and Tenerife, said Fernando Cano, spokesman at the Spanish rescue center in Madrid. Elizabeth Maxwell, wearing black, looked sombre but calm. Vice-Consul Livingstone said he heard her say "something to the effect that her husband was a colossus in life and a colossus in death." Maxwell was to have addressed the Anglo-Israel Association at a London hotel Monday night, but organizers were told about 30 minutes before the event began that he was ill. Maxwell is to be buried in Jerusalem, most likely on Sunday, but the timing depends on when the body is released by Spanish authorities, said Dov Judkowski, editor of the Israeli daily Maariv. Maxwell's empire has a major share in the paper. In an exclusive interview with the Observer as he departed for New York, where the newly-acquired Daily News is to receive his unique style of commercial attention for the next six months, Maxwell declared: 'The authorities have completed investigations and it is my understanding that they are about to prosecute a so-called City gentleman who has been selling the shares short and spreading rumours in order to buy them back cheaply. You are able to make huge amounts of money that way.' As to the identity of the prosecuting authority, or the nature of the job of the individual concerned, Maxwell would only say: 'Wait and see.' MCC's shares tumbled in September last year from levels of around 170p to 134p, and in January fell again to similar levels before recovering to 150p. At the time, the volatility was said to result from apprehension over debt levels and exercised put options. Market manipulation including 'reckless' statements is covered by section 47 of the Financial Services Act. After a busy week in which ex-Welsh secretary Peter Walker became non- executive chairman, Maxwell's son Kevin became chief executive and Pergamon press was sold to Dutch concern Elsevier for pounds 440million, MCC's shares closed 13.5p higher at 173p. Speaking aboard his private jet registration: VR-606 Maxwell dismissed speculation that MCC is under pressure from its bankers over levels of debt: 'Analysts don't bother to read the balance sheet. Comparisons with News Corporation are ridiculous. Unlike Mr Murdoch, I have had no meetings with bankers. Why should I?' EFTA01594355 Maxwell defined his priorities for the Daily News as: 'Get the advertisers back and get the sales back.' He promised that he would not be seeking to influence editorial policy.
