On Saturday, 8/10/2019, JEFFREY EPSTEIN was discovered unresponsive in
his jail cell at the Metropolitan Correctional Facility (MCC), 150 Park
Row, New York, NY. EPSTEIN was discovered with a fabricated noose around
his neck in what was an apparent suicide.
Preliminary investigation revealed a series of protocol failures by
MCC personnel, as well as technical failures/deficiencies within the MCC
at the time EPSTEIN was discovered.

As a result, a death investigation was initiated.

On August 10, 2019 at approximately 1345 hours the reporting investigator
met with BOP Lieutenant
in an administrative office on the 9th floor
opposite of the "L" tier. During that time a review of EPSTEIN's inmate
records and activity conducted with the following information obtained:
According to computer inquiries conducted at that time by II.
EPSTEIN had no phone calls on file with BOP. II. found
that
inquiry to be odd because she was informed that EPSTEIN had in fact made
a call on 08/09/2019. An inquiry of another inmate was conducted to
ensure the database was operating correctly or that the inquiry was
submitted correctly and phone records were revealed for the "test"
inmate run. EPSTEIN's 08/09/2019 call was provided by BOP supervisor
who also reported the call. II.
informed that
the call was made on an unsecure line or "legal line" which is not
recorded. II.
informed that the reason the call was placed in
that manner was because EPSTEIN related to
that there was an
issue with his phone account and he could not make a "normal call". When
asked to utilized EPSTEIN's code to make a "test" call to determine the
validity of the reason for the unsecure call, II. informed
that
it would be impossible to test because the system is voice recognizable
and voice activated. M. leurther
informed that inmates are given
calls once per every 30 days. It is one call that may last 15 minutes
max. All calls are made from within the cell and BOP personnel bring in
a receiver or headset for the inmate to utilize.

investigator did interview BOP nurse/medic
on the 9th floor
outside of the "L" tier.
informed that he has been a nurse at the
BOP for approximately 18 months and that on the date of incident he was

occasions at MCC, all of which EPSTEIN maintained a pleasant demeanor.
During the first instance, EPSTEIN asked
who he was, and
responded by introducing himself and explaining his position at the jail.
During another instance,
explained to EPSTEIN the policy regarding
meals during attorney sessions, and made certain EPSTEIN was accommodated
with water, visits to the restroom, etc. EPSTEIN spent most of the day with
his defense counsel, and was brought down as soon as attorney visiting
opened.
was made aware of the possibility that EPSTEIN would be housed at
MCC in advance of EPSTEIN'S arrival.
was not present when inmate
EPSTEIN was admitted to the facility.
EPSTEIN was thoroughly vetted to
determine if he was fit for General Population (GP) and was ultimately
placed in the Special Housing Unit (SHU). MCC places inmates under three
categories of close supervision: 1. "Dry Cell" for those at risk for
smuggling contraband, 2. Psychological Observation, and 3. Suicide Watch.
advised that EPSTEIN preferred not to have a cellmate and engaged
in manipulative behavior to avoid having one, including requesting to see a
psychologist. At EPSTEIN'S request, he was interviewed by a psychologist.
Following this assessment, EPSTEIN was initially placed on Suicide Watch.
He was later interviewed again and downgraded to Psychological Observation,
because he was determined not to have suicidal tendencies. After some time,
he was returned to the SHU.
began hearing talk that EPSTEIN was
trying to get back on Suicide Watch. Information like this is usually
generated from rounds, "kites", and monitoring of phone calls and letters.
On or about July 23, 2019, EPSTEIN was found unresponsive on the floor of
his cell with a homemade piece of fabric on his chest. EPSTEIN'S cellmate
had flagged the attention of a staff member, who handcuffed the cellmate and
removed EPSTEIN to bring him to the medical unit.
heard from his
staff that EPSTEIN may have been faking unconsciousness, because he was
observed opening his eyes and making other suspicious movements not
consistent with an unconscious state.

became coherent. EPSTEIN claimed that his cellmate, NICHOLAS TARTAGLIONE,
tried to take his life.
He was placed back on Suicide Watch for
approximately one week. Unlike his first and previous placement on Suicide
Watch, EPSTEIN now has definitive suicidal tendencies reported in his
incarceration history.
The staff was tasked with determining whether
EPSTEIN was in fact suicidal, or using manipulative tactics to avoid
assignment of a cellmate.
After Suicide Watch, EPSTEIN was placed on
Psychological Observation and eventually returned to the SHU.
At the direction of the Warden,
initiated the process of compiling
possible cellmates for EPSTEIN, vetting them, and submitting candidates to
the Warden for his review.
and his staff fully screened potential
cellmates and reported their determinations up to the Warden. EFRAIN REYES
was selected and housed in a cell with EPSTEIN.
The Assistant Warden,
Warden, and Regional Director were notified.
The Warden directedlill'Illon multiple occasions that EPSTEIN needed a
cellmate at all times, and
verbally informed his Lieutenants the
same.
repeatedly directed his SHU Lieutenant, Lieutenant
that
EPSTEIN needed a cellmate at all times.
Additionally,
visited the
SHU on multiple occasions and directed staff to be very alert and attentive
about EPSTEIN'S special accommodations.
On Friday, August 9, 2019, Lieutenant-as
on leave and, thus, there
was no dedicated Lieutenant assigned to the SHU.
In this event, the
Operation Lieutenant, Lieutenant
had oversight that day and took
over the responsibilities of the SHU Lieutenant.
Lieutenant
was
aware that EPSTEIN was required to be housed with a cellmate, because
approximately one week prior to EPSTEIN'S death,
informally advised
his Lieutenants that EPSTEIN was not be housed alone, and emphasized the
need to be vigilant about "3D-minute checks" and unannounced rounds.
Inmates/cellmates are moved for various reasons, including but not
limited to, an incident in the cell, visits to court, legal library,
medical, and recreation.
On Friday, August 9, 2019, EPSTEIN'S cellmate,
REYES, had court. It would not be uncommon for REYES to be out of his cell
for an extended period.
EPSTEIN had an attorney session that day.
EPSTEIN'S attorney was processed into the facility in the morning and
EPSTEIN was brought down to the attorney room.

following court, their property is retrieved from their cell, boxed, and
secured with a property form by Receiving and Discharge staff.

are normally accounted for and inventoried. In order to enter the SHU, all
staff not assigned there must identify themselves and sign the logbook, then
be physically escorted by a Correctional Officer. Alternatively, the staff
can pick up inmate property at the Unit door.
A Correctional Officer

his staff were under the impression that REYES was released from the SHU,
which
later confirmed was not true.
The purpose of the 3:00 AM and 5:00 AM counts is to physically count and
confirm each person in each cell.
There were no entries of counts in
TRUSCOPE the entire night. If technology is down, the Correctional Officers
also have the option to document the count on a hardcopy form.
Although
there are no electronic records of counts, hardcopies may have been
retained.
All inmate phone calls in the SHU are monitored and inmates have limited
access to phone calls. All calls should be recorded.

of any issues or complaints with EPSTEIN related to phone calls. On
Saturday, August 10, 2019,
was told that EPSTEIN made a phone call at
approximately 7:00 PM on the evening of Friday, August 9, 2019.
It is
uncommon to make an unrecorded phone call in the SHU, and-

advise against it because calls should be surveilled.
Inmates can make a
recorded phone call in the Lieutenant's Office, where it is documented in a
monitored logbook.
In the SHU, Correctional Officers are not permitted to
give inmates phone calls, but a Unit Team Member or the Chaplain can take
the inmate to the Lieutenant's office to make a call.

case managers. However, he is currently without one counselor and case
manager, which MCC is looking to hire, in addition to a secretary.
Each day, there are three working watches at the MCC. The day watch
begins at 7:30 a.m. and ends at 4:00 p.m. The night watch begins at 4:00
p.m. and ends at midnight. The morning watch begins at midnight and ends at
8:00 a.m. Corrections Officers (COs) hold the rank of GS-5, GS-6, GS-7, or
GS-8. They are organized into four groups; SHU 1, SHU 2, SHU 3, and SHU 4.
Typically, the SHU 1 CO has the keys and therefore can't go down range and
interact with inmates. SHU 1 opens and closes the doors and completes
paperwork. SHU 2, 3, and 4 conduct rounds, provide the inmates with food,
and secure the showers. At other BOP facilities where
has worked,
each group would be responsible for a separate range but that is not how it
is organized at MCC, where each group does all ranges. There are six ranges
within
area of responsibility but only lieutenants can access one
of the G range.
Two COs perform a count of all inmates at midnight, 3:00 a.m., and 5:00
a.m. In addition to these counts, COs conduct rounds every half-hour once
the unit is locked down and the inmates are secured in their cell . B h
counts and rounds are recorded, but on different types of sheets.

Officer.
COs report to lieutenants, either the Operations Lieutenant or the
Activities Lieutenant. The Operations Lieutenant handles overall issues
while the Activities Lieutenant handles rounds and communication with staff.
The day and night watch have both lieutenants on staff, but the morning
watch only has the Operations Lieutenant. During the evening watch, the
Activities Lieutenant makes a single round through his/her assigned units so
that inmates have access to someone higher up the chain of command than
their normal COs. During the morning watch, the Operations Lieutenant does
the round. There is no sheet that documents these watches, but the
lieutenants do keep a log of their rounds. On August 9, 2019, the day before
JEFFREY EPSTEIN was found deceased in his cell, Lieutenant

In the SHU, inmates are allowed a single social call once a month,
lasting fifteen minutes. To make a legal call, inmates must make a written
request, called a cop-out. On days when inmates aren't allowed to shower,

was being escorted downstairs to meet with his lawyers on either Wednesday
or Thursday. EPSTEIN told
he needed to set up his pack and pin,
which allows inmates to make social calls. However, EPSTEIN had been unable
to set it up because he was always meeting with his lawyers and was never in
the SHU. EPSTEIN asked
to assist him because his normal unit manager

by EPSTEIN from the MCC was the three-minute call given to inmates at the

complacency to develop. One example of the difference between those other
facilities and MCC is that MCC SHU inmates are allowed multiple sets of
clothing and bedsheets at a time. Another example is that other SHUs have a
color-coded board in the SHU office visually depicting special needs of
inmates. Such a board would have provided a visual reminder to all SHU
employees that EPSTEIN was to have a cellmate at all times.
